ELECTORAL (AMENDMENT) ORDER, 1961.

The Minister for Local Government in exercise of the powers conferred on him by section 21 of the Electoral Act, 1923 (No. 12 of 1923) and rule 16 of the First Schedule thereto as amended by sections 8 and 9 of the Electoral Act, 1960 (No. 43 of 1960) hereby orders as follows :—

1.—(1) This Order may be cited as the Electoral (Amendment) Order, 1961.

(2) This Order and the Electoral Order, 1946 (S.R. and O. 1946 No. 96) shall be construed as one and may be cited together as the Electoral Orders, 1946 and 1961.

2.—(1) The following provisions shall apply as respects the manner and order in which the names in the postal voters list for a constituency shall be arranged :—

(a) The said list shall be kept in two Parts and shall be in the form E.A. 19 in the Schedule hereto ;

(b) Part I of the said list shall contain the names of electors who are members of the Defence Forces and shall record their Army numbers, units of service and, where an elector is a commissioned or non-commissioned officer, his rank ;

(c) Part II of the said list shall contain the names of electors who are members of the Garda Síochána ;

(d) The electors shall be numbered consecutively in Part I and Part II of the said list beginning with the number one in each Part ;

(e) Where a constituency comprises more than one registration area, the electors shall be numbered consecutively beginning with the number one in the area of each registration officer ;

(f) In Part II of the said list, the address of the qualifying premises shown for an elector in the register of electors shall be entered for each elector and if an elector is not ordinarily resident at such address, the address at which he ordinarily resides shall be entered on the said list ;

(g) The names of the electors in the said list shall be arranged under polling districts in the order in which they appear in the register of electors for each such district ;

(h) Where an entry in the said list relates to an elector who is registered as a local government elector only, the words " (Local Elections only) " shall be inserted after his name on the said list.

(i) The names of the electors in any borough, urban district or town with town commissioners shall be shown in the said list separately by polling districts under the name of the borough, urban district or town ;

(j) Where a local electoral area is situated partly in one constituency and partly in another, the name of the constituency in which the remainder of the area is situated shall be noted after any reference in the said list to the said area.

(2) This article shall apply to the postal voters list for a constituency compiled from the register of electors for the constituency coming into force on the 15th day of April, 1962 and from subsequent registers of electors.

3. The First Schedule to the Electoral Order, 1946 shall be amended by :—

(a) the substitution for Forms E. A. 20 and E. A. 21 of Form E. A. 21 in the Schedule hereto,

(b) the deletion of Form E. A. 22,

(c) the substitution in Form E. A. 23 of " receipts " for " declarations of identity " and

(d) the substitution, as respects the register of electors coming into force on the 15th day of April, 1962 and subsequent registers of electors, of Form E. A. 19 in the Schedule hereto for Form E. A. 19 in the said First Schedule.

4. The Electoral (Amendment) Order, 1951 ( S.I. No. 242 of 1951 ) is hereby revoked.

INSTRUCTIONS FOR VOTING

1. Write the figure 1 in the space on the ballot paper opposite the name of the candidate of your first choice, the figure 2 opposite that of your second choice and so on.

DO NOT place any mark on the paper by which you may afterwards be identified. If you do your paper will be void and will not be counted.

DO NOT let anyone else see how you have voted.

2. After you have voted, put the ballot paper into the small envelope (marked " Ballot Paper Envelope ") and close it. Then put the ballot paper envelope TOGETHER WITH THIS RECEIPT into the large envelope (which is addressed to the Returning Officer) and post it at once.

If you do not post it at once, your vote may be too late to be counted.

EXPLANATORY NOTE.

This Order is consequential on the Electoral Act, 1960 , which provides for the entry in postal voters lists of members of the Garda Siochana and members of the Defence Forces. It directs the manner and order in which the names are to be arranged in the lists compiled from the register of electors coming into force on 15th April, 1962, and subsequent registers. The Order also prescribes a new form of receipt for postal voters' ballot papers instead of the declaration of identity formerly required and now abolished by the Electoral Act, 1960 ; it also deletes from the Electoral Order, 1946 the prescribed form of envelopes for postal voters and revokes the Electoral (Amendment) Order, 1951 which prescribed a form of statement to be made by a member of the Defence Forces opting to vote by post or in person.
