BACON EXPORT SUBSIDY (No. 1) ORDER, 1959.

In exercise of the powers conferred on it by Section 40 of the Pigs and Bacon (Amendment) Act, 1939 (No. 35 of 1939) and Section 13 of the Pigs and Bacon (Amendment) Act, 1956 (No. 37 of 1956) and with the concurrence of the Minister for Agriculture the Pigs and Bacon Commission hereby orders as follows :—

1. This Order may be cited as the Bacon Export Subsidy (No. 1) Order, 1959.

2. This Order shall apply only to bacon exported by a Licensee which was produced on the premises to which the Licensee's licence relates. For the purpose of this Order the bacon to which the Order applies shall be divided into Four Classes—

Class I shall mean bacon (other than bacon exported as ships' stores) of the quality and description defined in Article 3 hereof as being of Grade " A " standard.

Class II shall mean pre-packaged bacon, that is, bacon packaged in lots weighing not more than 5 lb. marketed in a condition suitable for sale direct to the consumer without further processing, slicing or cutting and derived from the carcases of Grade " A " pigs as defined in (i) the Pigs and Bacon Acts, 1935 to 1940 (Pigs and Bacon Commission) Regulations (No. 2) Order, 1955, as amended by the Pigs and Bacon Acts, 1935 to 1940 (Pigs and Bacon Commission) Regulations (Amendment) (No. 1) Order, 1956, in the case of bacon pigs slaughtered at licensed premises on or before 30th June, 1958, and (ii) the Pigs and Bacon Acts, 1935 to 1956 (Pigs and Bacon Commission) Grading (No. 1) Order, 1958 ( S.I. No. 144 of 1958 ) in the case of bacon pigs slaughtered at licensed premises on or after 1st July, 1958.

Class III shall mean bacon exported as ships' stores, of the quality and description defined in Article 3 hereof as being of Grade " A " standard.

Class IV shall mean all other bacon not falling within Class I, or Class II or Class III.

3. In this Order bacon of Grade " A " standard means—

(a) Wiltshire sides cut and trimmed according to good trade practice, of an ex-factory net weight of not less than 46 lb. and not more than 65 lb. in the case of bacon produced from pigs slaughtered at licensed premises on or before the 30th June, 1958, and not less than 49 lb. and not more than 65 lb. in the case of bacon produced from pigs slaughtered at licensed premises on or after 1st July, 1958, of a quality and in a condition suitable for the best retail trade and conforming to the following measurements of the exterior back fat including rind, viz :—

(a) In the case of bacon produced from pigs slaughtered at licensed premises on or before the 30th June, 1958 : ¾ inch.

(b) In the case of bacon produced from pigs slaughtered at licensed premises on or after 1st July, 1958 : 5/8 inch.

(b) Backs, Middles, Shoulderless Sides and Spencers (Gammonless Sides) cut and trimmed according to good trade practice, of a quality and in a condition suitable for the best retail trade and derived from the carcases of Grade " A " pigs as defined in (i) the Pigs and Bacon Acts, 1935 to 1940 (Pigs and Bacon Commission) Regulations(No. 2) Order, 1955, as amended by the Pigs and Bacon Acts, 1935 to 1940 (Pigs and Bacon Commission) Regulations (Amendment) (No. 1) Order, 1956, in the case of bacon pigs slaughtered at licensed premises on or before 30th June, 1958, and (ii) the Pigs and Bacon Acts, 1935 to 1956 (Pigs and Bacon Commission) Grading (No. 1) Order, 1958, in the case of bacon pigs slaughtered at licensed premises on or after 1st July, 1958.

4. Subject as hereinafter provided every Licensee who exports bacon of any Class to which this Order applies shall be paid a subsidy at the rate hereinafter specified appropriate to bacon of such Class.

5. (a) In respect of Class I bacon exported during any period specified in the first column of the schedule to this Order the rate of subsidy shall be as set out in the second column of the schedule opposite the mention of the period.

(b) In respect of Class II bacon exported during any period specified in the first column of the schedule the rate of subsidy shall be one and one half times the rate appropriate to Class I bacon exported during the same period.

(c) In respect of Class III bacon exported during any period specified in the schedule the rate of subsidy shall be the rate appropriate to Class I bacon exported during the same period less 11s. 6d. per cwt.

(d) In respect of Class IV bacon the subsidy shall be at the nominal rate of 1d. per cwt. on the net quantity exported on or after the 17th January, 1958, but no subsidy shall be payable in respect of bacon of this Class exported on or after the 18th January, 1958.

(e) For the purposes of this Order the net quantity exported shall mean the net weight of bacon dispatched from the Licensee's premises less an allowance of 1% for shrinkage.

6. Payment of the subsidy will be subject to compliance by the Licensee with such conditions as may be contained in Regulations made by the Commission.

7. This Order shall be deemed to have come into force on Friday, the 17th day of January, 1958.

8. Unless a contrary intention is indicated by the context all words and expressions used in this Order shall be construed as in the Pigs and Bacon Acts, 1935 to 1956.

EXPLANATORY NOTE.

This Order fixes the rate of subsidy payable to licensed bacon curers on bacon exported during period from 17th January, 1958 to 27th August, 1959, inclusive.
