AIR-RAID PRECAUTIONS (APPROVAL OF EXPENDITURE BY LOCAL AUTHORITIES) (AMENDMENT) REGULATIONS, 1959.

I, Caoimhghín Ó Beóláin, Aire Cosanta, in exercise of the powers conferred on me by section 36 of the Air-raid Precautions Act, 1939 (No. 21 of 1939), do hereby, with the concurrence of An tAire Airgeadais testified by his signature hereto, make the following regulations :—

1. These Regulations may be cited as the Air-raid Precautions (Approval of Expenditure by Local Authorities) (Amendment) Regulations, 1959.

2. In these Regulations the expression " the Principal Regulations " means the Air-raid Precautions (Approval of Expenditure by Local Authorities) Regulations, 1939 ( S. R. & O. No. 401 of 1939 ).

3. Regulation 6 of the Principal Regulations is hereby amended by the insertion at the end of that Regulation of the following two new paragraphs :—

" (4) The Minister may if he thinks fit, permit any local authority to incur during a specified period expenditure of a non-capital nature as regards any specified item or items the cost of which does not exceed a specified sum, and in that case any expenditure incurred by such local authority in accordance with such permission (which may be granted in general or specified terms) shall be deemed, for the purpose of paragraph (2) of this Regulation, to have been incurred as if the Minister had sanctioned an estimate for such expenditure in accordance with paragraph (1) of this Regulation.

(5) The Minister may at any time withdraw any permission granted under paragraph (4) of this Regulation. "

4. The references in the Principal Regulations to section 35 of the Air-raid Precautions Act, 1939 (No. 21 of 1939), shall be construed as references to the said section as amended by section 4 of the Air-raid Precautions (Amendment) Act, 1946 (No. 28 of 1946).

EXPLANATORY NOTE.

These amending Regulations are designed to simplify the procedure in relation to the approval of expenditure by local authorities in discharging their statutory functions in respect of Civil Defence.
