RIVER ERNE (FISHING BY HOLDERS OF SPECIAL LOCAL LICENCES) REGULATIONS, 1959.

I, ERSKINE H. CHILDERS, Minister for Lands, in exercise of the powers conferred on me by section 8 of the Fisheries (Tidal Waters) Act, 1934 (No. 24 of 1934), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1957 ( S.I. No. 67 of 1957 ), hereby make the following regulations :

1.—(1) These Regulations may be cited as the River Erne (Fishing by Holders of Special Local Licences) Regulations, 1959.

(2) These Regulations shall come into operation on the 1st day of June, 1959.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

" weekly fishing time " means the period commencing at 6 a.m. on Monday and ending at 6 a.m. on the following Friday or such shorter period during which it shall be lawful to use an engine other than a rod and line for the capture of salmon ;

" licensee " means the holder of a special local licence to use a draft net in the tidal waters of the River Erne.

4.—(1) In the tidal waters to which this paragraph applies—

(a) a licensee may fish during the weekly fishing time in the period commencing at 6 a.m. on the 1st day of June, 1959, and ending at midnight on the 20th day of July, 1959, and at no other time ;

(b) draft nets shall not be used at a less distance from each other than one hundred yards ;

(c) nets shall not be shot simultaneously from points on both banks which are opposite to each other, so as to be in the water at the same time, and a net shot from one bank shall be beached before another net is shot from an opposite point on the other bank.

(2) Paragraph (1) of this Article applies to—

(a) the tidal waters of the River Erne other than the portion thereof which is situated upstream or to the eastward of a straight line drawn from Gibby Point to the northern most point of the townland of Portnason, and

(b) the tidal waters of the River Erne and Abbey River, other than the portions thereof which are situated upstream or to the northward of a straight line drawn from the town boundary of Ballyshannon where it meets high water mark at Whitehill Point to the point of land two hundred and seventy yards northward of Gibby Point.

EXPLANATORY NOTE.

These Regulations prescribe the times, places and conditions for the use of draft nets in the tidal waters of the River Erne.
