RIVER LEE HYDRO-ELECTRIC SCHEME (NON-APPLICATION OF SECTION 33 (1) OF ELECTRICITY (SUPPLY) (AMENDMENT) ACT, 1945) ORDER, 1958.

WHEREAS the Electricity Supply Board is empowered by the Electricity (Supply) (Amendment) Act, 1945 (No. 12 of 1945), to submerge a bridge for the purpose of the execution of any works :

AND WHEREAS in pursuance of the scheme approved of by the River Lee Hydro-Electric Scheme Approval Order, 1949 ( S.I. No. 321 of 1949 ), a bridge over the river Dripsey was submerged :

AND WHEREAS the Minister for Industry and Commerce, after consultation with the Minister for Local Government, is satisfied that, having regard to all the circumstances of the case, a new bridge in lieu of the bridge so submerged is not required :

NOW, I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by subsection (2) of section 33 of the Electricity (Supply) (Amendment) Act, 1945 (No. 12 of 1945), hereby order as follows :

1. This Order may be cited as the River Lee Hydro-Electric Scheme (Non-application of section 33 (1) of Electricity (Supply) (Amendment) Act, 1945 ) Order, 1958.

2. Subsection (1) of section 33 of the Electricity (Supply) (Amendment) Act, 1945 (No. 12 of 1945), shall not apply or have effect in relation to the bridge over the River Dripsey which was submerged in pursuance of the River Lee Hydro-Electric Scheme.

EXPLANATORY NOTE.

The effect of this instrument is to relieve the Electricity Supply Board of the obligation to erect a bridge in lieu of one which was submerged in pursuance of the River Lee Hydro-Electric Scheme.
