BOVINE TUBERCULOSIS (GENERAL PROVISIONS), ORDER, 1957.

I, SEÁN MOYLAN, Minister for Agriculture, it appearing to me to be necessary for the purpose of the progressive eradication of bovine tuberculosis, do hereby, in exercise of the powers conferred on me by section 22 of the Diseases of Animals Act, 1894, and section 2 of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957), order as follows :

1 Short title and commencement.

1.—(1) This Order may be cited as the Bovine Tuberculosis (General Provisions) Order, 1957.

(2) This Order shall come into operation on the 1st day of November, 1957.

2 Definitions.

2. In this Order—

" the Act " means the Diseases of Animals (Bovine Tuberculosis) Act, 1957 (No. 14 of 1957) ;

" the Minister " means the Minister for Agriculture.

3 Tuberculin testing.

3.—(1) The test to be used in testing animals other than poultry for tuberculosis pursuant to the Act or any order made thereunder shall be the single comparative intradermal tuberculin test with P.P.D. Weybridge mammalian and avian tuberculins.

(2) A test shall be carried out by a registered veterinary surgeon.

(3) A test shall not be carried out in circumstances which may affect its accuracy.

(4) The owner of an animal proposed to be or being tested shall inform the veterinary surgeon of the existence of any circumstances of which he may be aware, including the previous use or application of tuberculin or johnin, which may affect the accuracy of the test.

4 Vaccination.

4. Cattle shall not be vaccinated against tuberculosis or Johne's Disease (para-tuberculosis) except with the consent of the Minister.

5 Marking.

5.—(1) Where any animals are tested for tuberculosis pursuant to the Act or any Order made thereunder and they have not already been marked for the purpose of identification, their owner shall cause them to be so marked.

(2) An authorised person within the meaning of section 7 of the act may apply or cause to be applied to any such animal any mark which he considers necessary for the purpose of identification.

(3) No person shall efface, obliterate, alter or remove and mark under this Article or apply any marking that could be confused with such mark.

Explanatory Note.

This Order prescribes the type of test to be used for the purposes of the Diseases of Animals (Bovine Tuberculosis) Act, 1957 , or any Order made under the Act. It provides that a test may not be carried out in any circumstances which may affect its accuracy.

The vaccination of cattle against tuberculosis or Johne's Disease is prohibited.
