S.I. No. 157 of 1957.

OFFENCES AGAINST THE STATE (AMENDMENT) ACT, 1940 (COMMISSION FOR INQUIRING INTO DETENTIONS) ORDER, 1957.

WHEREAS it is enacted by section 8 of the Offences Against the State (Amendment) Act, 1940 (No. 2 of 1940), that, as soon as conveniently may be after Part II of that Act comes into force, the Government shall set up a Commission to perform the functions imposed on such Commission by that section, and that the members of such Commission shall be appointed by the Government :

AND WHEREAS the said Part II of the said Act came into force on the 8th day of July, 1957 :

NOW, the Government, in pursuance of section 8 of the Offences Against the State (Amendment) Act, 1940 (No. 2 of 1940), and in exercise of the powers conferred by that section, hereby order as follows :—

1. This Order may be cited as the Offences Against the State (Amendment) Act, 1940 (Commission for Inquiring into Detentions) Order, 1957.

2. The Commission required by section 8 of the Offences Against the State (Amendment) Act, 1940 (No. 2 of 1940), to be set up is hereby set up and shall be known and is in this Order referred to as the Commission for Inquiring into Detentions.

3. The following persons are hereby appointed to be members of the Commission for Inquiring into Detentions, that is to say :—

BARRA Ó BRIAIN,

a Judge of the Circuit Court of Justice,

ÉAMONN Ó RIAIN

(Edward Ryan),

a Justice of the District Court of Justice,

and

SEÁN SEÓIGH

(John Vincent Joyce),

a Colonel in the Defence Forces.

Explanatory Note.

This Order sets up a Commission for inquiring into detentions under Part II of the Offences Against the State (Amendment) Act, 1940 .
