PENSIONS (INCREASE) (WATERFORD HARBOUR COMMISSIONERS) REGULATIONS, 1957.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Section 6 of the Pensions (Increase) Act, 1956 (No. 44 of 1956), hereby make the following regulations :

1. These Regulations may be cited as the Pensions (Increase) (Waterford Harbour Commissioners) Regulations, 1957.

2. In these Regulations—

" the Act " means the Pensions (Increase) Act, 1956 (No. 44 of 1956) ;

" the appropriate sum " has the meaning given to it in the Act ;

" the harbour authority " means the Waterford Harbour Commissioners ;

" pension " means a pension or allowance specified in Part IV. of the Schedule to the Act.

3. The increase which may be granted by the harbour authority under the Act in a pension in respect of service which ended before the 18th day of August, 1952, shall not exceed whichever of the following is the less—

(a) the appropriate sum, or

(b) the difference between the amount of the pension and the amount that would be payable if the pension were computed by reference to an annual average amount of pensionable remuneration determined as if the rate of annual salary or weekly pay which first commenced to be paid on the 18th day of August, 1952, to an officer or servant of equivalent status had been in effect in the case of the officer or servant concerned for the whole of the three years immediately preceding his retirement.

4. The increase which may be granted by the harbour authority under the Act in respect of service which ended on or after the 18th day of August, 1952, but before the 1st day of August, 1955, in any category specified in the Schedule to these Regulations shall not exceed whichever of the following is the less—

(a) the fraction of the appropriate sum mentioned in the second column of the Schedule opposite the mention of such category, or

(b) the difference between the amount of the pension and the amount that would be payable if the pension were computed by reference to an annual average amount of pensionable remuneration determined as if the rate of weekly pay which first commenced to be paid on the 18th day of August, 1952, to a servant of equivalent status had been in effect in the case of the servant concerned for the whole of the three years immediately preceding his retirement.

SCHEDULE.

Fireman on the Dredger, " Portláirge."

Four-twelfths of the appropriate sum.

Night watchman on the Dredger " Portláirge."

Two-twelfths of the appropriate sum.

Labourer.

One-twelfth of the appropriate sum.

EXPLANATORY NOTE.

These Regulations authorise the Waterford Harbour Commissioners to increase certain superannuation allowances payable by them.
