SUGAR (MAXIMUM PRICES) ORDER, 1957.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939) as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), hereby order as follows :—

1. This Order may be cited as the Sugar (Maximum Prices) Order, 1957.

2.—(1) In this Order—

" delivery " means delivery free of cost at the unloading point of whichever of the following transport services is nearest to the premices of the purchaser—

the railway or regular road goods service or the canal service of Coras Iompair Eireann,

the railway or regular road service of the Great Northern Railway Company (Ireland);

" sugar " does not include molasses, treacle, glucose or lactose, or cube sugar, icing sugar, pulverised sugar, mineral water sugar, medium crystals sugar, superfine sugar, castor sugar or any sugar which has been subject to chemical processes resulting in inversion ;

" cube sugar ", " icing sugar " and " pulverised sugar " have the meanings attached to them by custom in the trade ;

" mineral water sugar " means a sugar which contains not more than fifty spores of flat sour bacteria per ten grams of sugar, not more than one positive tube out of six tubes containing spores of thermophilic anaerobes (not producing H2S), and not more than five spores of sulphide spoilage bacteria per ten grams of sugar ;

medium crystals sugar " means a sugar of which at least 80% will not pass through a No. 18 Fine Test sieve ;

" superfine sugar " means a sugar of which at least 70% will pass through a No. 36 Fine Test sieve ;

" castor sugar " means a sugar (other than castor sugar produced by pulverising) of which at least 70% will pass through a No. 25 Fine Test sieve ;

" Fine Test sieve " means a sieve of the class described as fine test sieves in the Standard Specification (Test Sieves) Order, 1950, ( S.I. No. 293 of 1950 ).

(2) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. No person shall sell sugar by wholesale at a price exceeding a price calculated at the rate of 64s. 2d. per hundredweight.

4. No person shall sell sugar by retail at a price exceeding a price calculated at the rate of 7½.d per pound.

5. The price specified in Article 3 of this Order shall be deemed to include delivery in the case of sugar sold in quantities of one hundredweight and upwards.

6. This Order shall not apply to sugar sold for use in the manufacture of goods for export.

7. The Sugar (Maximum Prices) Order, 1955, ( S.I. No. 212 of 1955 ), is hereby revoked.

EXPLANATORY NOTE

This instrument increases the maximum wholesale price of sugar from 59s. 6d. per cwt. to 64s. 2d. per cwt. and the maximum retail price of sugar from 7d. per lb. to 7½d. per lb. as from 1st May, 1957.
