DISABLED PERSONS (MAINTENANCE ALLOWANCES) (AMENDMENT) REGULATIONS, 1957.

The Minister for Health, in exercise of the powers conferred on him by section 5 of the Health Act, 1947 (No. 28 of 1947), and by subsection (5) of section 50 of the Health Act, 1953 (No. 26 of 1953), hereby makes the following Regulations :

1. These Regulations may be cited as the Disabled Persons (Maintenance Allowances) (Amendment) Regulations, 1957.

2. In these Regulations—

" the Principal Regulations " means the Disabled Persons (Maintenance Allowances) Regulations, 1954 ( S.I. No. 207 of 1954 ).

3. Article 4 of the Principal Regulations shall be amended by—

(a) the insertion in sub-article (a) of " or of any other medical officer of the health authority authorised by them to examine persons applying for or in receipt of maintenance allowances " after " chief medical officer of the health authority," and

(b) the deletion in sub-article (b) of " by or at the expense of a local authority."

4. Article 6 of the Principal Regulations shall be amended by the addition thereto of the following new sub-article :—

" (c) that person shall notify the health authority of any change in his medical condition or in his circumstances or those of his relatives (within the meaning of subsection (6) of section 50 of the Act) material to his entitlement to the allowance."

EXPLANATORY NOTE.

The effect of these Regulations is to permit authorised medical officers, in addition to the County Medical Officer, to certify applicants for disablement allowances paid under the Health Act, 1953 , to amend the position regarding entitlement to such allowances of persons in institutions and to require a recipient to notify the health authority of any alteration in the factors governing his eligibility for the allowance.
