IRISH NATIONALITY AND CITIZENSHIP REGULATIONS, 1956.

I, JAMES EVERETT, Minister for Justice, in exercise of the powers conferred on me by section 3 of the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956), hereby, with the consent, in so far as these Regulations relate to fees, of the Minister for Finance, make the following regulations :

1. These Regulations may be cited as the Irish Nationality and Citizenship Regulations, 1956.

2. In these Regulations " the Act " means the Irish Nationality and Citizenship Act, 1956 (No. 26 of 1956).

3. Every declaration of Irish citizenship under subsection (1) of section 7 of the act shall—

(a) if made by a person of full age, be in the Form 1 in the Schedule hereto,

(b) If made by the parent or guardian of a person who is not of full age, be in the Form 2 in the Schedule hereto,

and shall be sent by registered post to, or left with, the Secretary, Department of Justice, Dublin.

4. Every declaration under subsection (1) of section 8 of the act, by an alien woman accepting Irish citizenship shall be in the Form 3 in the Schedule hereto and shall be sent by registered post to, or left with, the Secretary, Department of Justice, Dublin, or the head of an Irish diplomatic mission or consular office.

5. Every declaration of fidelity to the nation and loyalty to the State under paragraph (f) of section 15 of the act shall be in the Form 4 in the Schedule hereto.

6. Every application under subsection (1) of section 17 of the act for a certificate of naturalisation shall—

(a) if made by a person of full age, be in the Form 5 in the Schedule hereto,

(b) if made by a naturalised Irish citizen acting on behalf of his minor child, be in the Form 6 in the Schedule hereto,

(c) if made by a parent or guardian acting on behalf of a minor of Irish descent or Irish associations, be in the Form 7 in the Schedule hereto,

7. Every certificate of naturalisation granted to a person of full age under section 15 or section 16 of the act shall be in the Form 8 in the Schedule hereto.

8. Every certificate of naturalisation granted under section 16 of the act for a minor shall be in the Form 9 in the Schedule hereto.

9. Every notice under subsection (2) of section 18 of the Act of the issue of a certificate of naturalisation to be published in Iris Oifigiúil shall be in the Form 10 in the Schedule hereto.

10. Every annual registration under paragraph (c) of subsection (1) of section 19 of the act shall be in the Form 11 in the Schedule hereto and shall be sent by registered post to, or left with, the Secretary, Department of Justice, Dublin, or the head of an Irish diplomatic mission or consular office.

11. The notice which the Minister for Justice is required under subsection (2) of section 19 of the act to give shall be three months' written notice served personally on the person concerned or sent to him by registered post.

12. Every application for an enquiry under subsection (2) of section 19 of the act shall be made by letter sent by registered post to, or left with, the Secretary, Department of Justice, Dublin.

13. Every declaration of alienage under subsection (1) of section 21 of the act shall be in the Form 12 in the Schedule hereto and shall be sent by registered post to, or left with, the Secretary, Department of Justice, Dublin.

14. The following fees shall be paid by the declarant or the applicant, as the case may be :

(a) on the making of a declaration by an alien woman accepting Irish citizenship, a fee of five pounds ;

(b) on the issue of a certificate of naturalisation—

(i) where the application is made on behalf of a minor, a fee of two pounds ;

(ii) where the application is made by a married woman whose husband is or is about to become an Irish citizen by naturalisation, a fee of five pounds ;

(iii) where the application is made by a widow whose husband was, immediately before his death, an Irish citizen and who has not, subsequent to her husband's death, become a naturalised citizen of any other country, a fee of five pounds ;

(iv) where the application is made by a person born in Ireland who renounced his Irish citizenship in accordance with section 21 of the act, a fee of five pounds ;

(v) in the case of any other application, a fee of twenty pounds.

NOTES.

*Names should be written in block capital letters. The application must not be made in a name the use of which is prohibited by section 8 of the Aliens Act, 1935 .

† Nationality should be stated by reference to a sovereign state. If the applicant has no nationality he should state so under Heading No. 7 and he should state under Heading 25 how and when he lost his nationality.

If there is not sufficient space on the application form for a statement of any particulars, those particulars should be furnished in a separate statement which should be attached to the form and should be signed by the applicant in the presence of the person before whom the statutory declaration is made.

The Minister for Justice requires that every applicant for a certificate of naturalisation shall publish in a daily newspaper circulating in the district in which the applicant resides an advertisement in the following form :—

"NOTICE OF APPLICATION FOR A CERTIFICATE OF NATURALISATION."

"Notice is hereby given that...........................of.................... is applying to the Minister for Justice for a certificate of naturalisation, and that any person who knows of any reason why a certificate of naturalisation should not be issued to the applicant should send a written and signed statement of the facts to the Secretary, Department of Justice, Dublin."

The application, when completed, should be sent to the Secretary, Department of Justice, Dublin, together with a copy of the newspaper containing the notice of the application, with the notice clearly marked.

WARNING.

Sub-section (2) of section 17 of the Irish Nationality and Citizenship Act, 1956 , enacts that if any person for the purpose of or in relation to an application for a certificate of naturalisation gives or makes to the Minister for Justice any statement or information which is to his knowledge false or misleading in any material respect, he shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £50 or at the discretion of the court to imprisonment for any term not exceeding 6 months or to both such fine and such imprisonment.

EXPLANATORY NOTE.

These Regulations prescribe the procedure to be followed, the forms to be used and, in certain cases, the fees to be paid by persons who make declarations for the purpose of the Irish Nationality and Citizenship Act, 1956 , or who apply for certificates of naturalisation. They also prescribe the form of certificates of naturalisation which the Minister for Justice may grant, and the form of notice in Iris Oifigiúil of the granting of these certificates. The Regulations provide that the notice which the Minister must give to a naturalised citizen before revocation of a certificate of naturalisation is to be three months' written notice.
