FACTORIES ACT, 1955 (BUILDING OPERATIONS, ENGINEERING WORKS, DOCKS, ETC.) (MODIFICATION) REGULATIONS, 1956.

I, WILLIAM NORTON, Minister for Industry and Commerce, in exercise of the powers conferred on me by paragraph (l) of subsection (1) of section 86, subsection (2) of section 88 and subsection (2) of section 89 of the Factories Act, 1955 (No. 10 of 1955), hereby make the following regulations :

1.—(1) These Regulations may be cited as the Factories Act, 1955 (Building Operations, Engineering Works, Docks, etc.) (Modification) Regulations, 1956.

(2) These Regulations shall come into operation on the 1st day of October, 1956.

2. In these Regulations " the Act " means the Factories Act, 1955 (No. 10 of 1955).

3. Each provision of the Act mentioned in the first column of the Schedule to these Regulations shall, in its application by virtue of section 88 or section 89 of the act to building operations and works of engineering construction to which the said sections 88 and 89, respectively, apply, have effect with the modification indicated in the second column of the said Schedule opposite the mention of such provision.

4. Subsection (1) of section 122 of the act shall, in its application by virtue of section 86 of the act to docks, wharves, quays and warehouses to which the said section 86 applies, be construed as requiring every person who is by virtue of the said section 86 deemed to be the occupier of a factory to keep, in relation to the persons employed by him, and to those provisions of the Act for the observance of which he is responsible, a general register in the prescribed form in which shall be entered, or to which shall be attached, such of the particulars and reports mentioned in subsection (1) of the said section 122 as may be applicable.

SCHEDULE.

Factories Act, 1955 (No. 10 of 1955).

Modification.

Subsection (1) of section 17.

Paragraph (a) shall not apply.

Subsection (10) of section 40.

Shall be construed as if the words " used in any building operation or work of engineering construction to which this Act applies unless it has, within the preceding period of fourteen months, been examined " were substituted for the words " taken into use in any factory for the first time in that factory until it has been examined."

Subsection (6) of section 42.

Shall be construed as requiring that no air receiver shall be used in a building operation or work of engineering construction unless it has been cleaned and examined in accordance with the provisions of the said subsection within the preceding period of twenty-six months or such preceding period not exceeding four years as may have been specified under paragraph (a) of the said subsection.

Subsection (4) of section 80.

Shall have effect as if the following paragraph were inserted after paragraph (a) :

" (aa) with one or more specified employers or with any employer."

Subsection (1) of section 122.

Shall be construed as requiring every person who is by virtue of section 88 or section 89 of the act deemed to be the occupier of a factory to keep, in relation to the persons employed by him, and to those provisions of the Act for the observance of which he is responsible, a general register in the prescribed form in which shall be entered, or to which shall be attached, such of the particulars and reports mentioned in the said subsection (1) as may be applicable.
