SOCIAL WELFARE (CLAIMS AND PAYMENTS) (AMENDMENT) REGULATIONS, 1956.

The Minister for Social Welfare in exercise of the powers conferred on him by sections 3 and 29 of the Social Welfare Act, 1952 (No. 11 of 1952) hereby makes the following regulations :—

1. These Regulations may be cited as the Social Welfare (Claims and Payments) (Amendment) Regulations, 1956.

2. In these Regulations the expression " the Principal Regulations " means the Social Welfare (Claims and Payments) Regulations, 1952 ( S.I. No. 374 of 1952 ).

3. These Regulations and the Principal Regulations may be cited together as the Social Welfare (Claims and Payments) Regulations, 1952 and 1956.

4. Article 9 of the Principal Regulations is hereby amended by

(a) the deletion in sub-article (2) thereof of the words " his failure to make the claim " and the substitution therefor of the words " her failure to make a claim for maternity allowance or pension " ;

(b) the insertion after sub-article (2) thereof of the following sub-article—

" (2) (A). The Minister may, having regard to the circumstances of any case, extend the time within which a claim for marriage benefit or maternity grant may be made to the date of the making of the claim." ;

(c) the deletion of paragraphs (a) and (b) of sub-article (3) thereof.

5. Article 10 of the Principal Regulations is hereby amended by the deletion of sub-article (2) thereof and the substitution therefor of the following sub-article—

" (2) Where a claimant for maternity allowance or pension proves that—

(a) on a date earlier than the date on which her claim was made, apart from satisfying the condition of making a claim, she was entitled to the benefit claimed, and

(b) throughout the period between the earlier date and the date on which her claim was made there was good cause for delay in making such claimshe shall not be disqualified under this article for receiving the benefit to which she would have been entitled if the claim had been made on the said earlier date."

6. The amendments of the Principal Regulations made by these Regulations shall not apply to a claim for marriage benefit or maternity grant made in respect of a marriage or confinement occurring before the date of these Regulations and the Principal Regulations shall apply to any such claim.
