WATERFORD BOARD OF PUBLIC ASSISTANCE (HEALTH FUNCTIONS) ORDER, 1955.

The Minister for Health, in exercise of the powers conferred on him by section 45 of the Health Act, 1953 (No. 26 of 1953), hereby orders as follows :

1. This Order may be cited as the Waterford Board of Public Assistance (Health Functions) Order, 1955.

2. In this Order—

" the Act " means the Health Act, 1953 (No. 26 of 1953) ;

" the Corporation of Waterford " means the Mayor, Aldermen and Burgesses of Waterford ;

" the Board " means the Board of Public Assistance for the Waterford Public Assistance District.

3. (1) The Corporation of Waterford and the Council of the County of Waterford are hereby authorised to act jointly in the performance of their functions under subsection (5) of section 50 of the act, and such joint action shall be carried out by the Board.

(2) For the purpose of their performance of functions under subsection (5) of section 50 of the act in accordance with this order, section 2 of the Health Act, 1947 (No. 28 of 1947) and section 29 of the act shall apply to the Board in the same manner as they apply to a health authority.

(3) The Disabled Persons (Maintenance Allowances) Regulations, 1954 ( S.I. No. 207 of 1954 ) shall apply to the Board, and in such application—

(a) the expression " the health authority " in paragraph (a) of Article 4 of those Regulations shall, in respect of a person making an application for an allowance, be construed as meaning the health authority who, but for this order, would deal with that application, and

(b) the expression " health authority " where it otherwise occurs in those Regulations shall be construed as a reference to the Board.

(4) The money required to meet the expenses of the Board in performing functions in accordance with the provisions of thisarticle shall, at such times as shall be agreed upon between the Board and the health authorities, or, in default of agreement, as may be determined by the Minister, be recouped to the Board by the health authorities as follows :—

(a) each such health authority shall pay a sum equivalent to the total of the allowances under subsection (5) of section 50 of the act paid by the Board to persons normally resident in the functional area of that health authority ;

(b) the money to meet any other expenses of the Board shall be paid by such health authorities in the same proportions as the expenses of the Board under the Waterford Board of Public Assistance (Health Functions) Order, 1954 ( S.I. No. 164 of 1954 ) are supplied.

4. The money required to meet the expenses of the Board in performing functions in accordance with the provisions of the Waterford Board of Public Assistance (Health Functions) Order, 1954, shall, at such times as shall be agreed upon between the Board and the health authorities or in default of agreement as may be determined by the Minister, be supplied to the Board by the Corporation of Waterford and the Council of the County of Waterford rateably in proportion to the totals of the valuations appearing in the valuations lists for the time being in force under the Valuation Acts of the rateable property in the respective portions of the Waterford Public Assistance District situate in the county borough of Waterford and the county of Waterford respectively.
