NATIONAL SCHOOL TEACHERS' SUPERANNUATION (AMENDMENT) SCHEME, 1954.

I, SEÁN Ó MAOLÁIN, Minister for Education, with the consent of the Minister for Finance, testified by his signature hereto, in exercise of the powers conferred on me by the Teachers' Superannuation Act, 1928 (No. 32 of 1928), and of every and any other power me in this behalf enabling, hereby make the following Scheme :—

1 Short title and collective citation.

1. This Scheme may be cited as the National School Teachers' Superannuation (Amendment) Scheme, 1954, and this Scheme and the National School Teachers' Superannuation Schemes, 1934 to 1953, may be cited together as the National School Teachers' Superannuation Schemes, 1934 to 1954.

2 Commencement.

2. This Scheme applies to persons who reached the age of sixty-five years on or after the 1st day of July, 1953, and before the commencement of this Scheme as well as to persons who thereafter reach that age.

3 Interpretation.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

4 Payment of lump sum to persons retained in service after 65.

4.—(1) A person permitted to continue in the service as set out in subparagraph (1) of paragraph 11 of the National School Teachers' Superannuation (Amendment) Scheme, 1950 ( S.I. No. 180 of 1950 ), may, thereupon, be paid the lump sum to which he would be entitled on retirement with a pension.

(2) Where a lump sum is paid to a person under this paragraph no further lump sum shall be paid to him when he retires ; and, in the event of his death while in the service, the payment on death shall be reduced by the amount of the lump sum.
