S.I. No. 251/1953 - Garda Síochána Pensions Order, 1953.


I, GERALD BOLAND, Minister for Justice, in exercise of the powers conferred on me by section 13 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and of every and any other power me in this behalf enabling, hereby make, with the sanction of the Minister for Finance, testified by his official seal affixed hereto, the following Order :

1. This Order may be cited as the Garda Síochána Pensions Order, 1953.

2. The Garda Síochána Pensions Orders, 1925 to 1952, and this Order may be cited together as the Garda Síochána Pensions Orders, 1925 to 1953.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In this Order " the Order of 1922 " means the Dublin Metropolitan Police Pensions Order, 1922, as amended or varied by subsequent orders.

5.—(1) For the purposes of the Order of 1922, where a member of the Force had previously served for a period not being less than one year as a civil servant within the meaning of section 12 of the Superannuation Act, 1887, he shall be entitled to reckon his service in that capacity as approved service.

(2) For the purpose of so reckoning such service four years of service as a civil servant shall be regarded as equivalent to three years of approved service, and proportionately for any greater or lesser period than four years.

6. (1) The pensions, allowances and gratuities payable under the Order of 1922 or the Gárda Síochána Pensions Orders, 1925 to 1953, shall be awarded by the Minister with the consent of the Minister for Finance instead of as heretofore provided.

(2) The consent of the Minister for Finance may be given in respect of a particular case or a class of case.

7.—(1) Paragraph (1) of Article 5 of the Garda Síochána Pensions Order, 1951 ( S.I. No. 410 of 1951 ), is hereby amended by the substitution, in clause (iii) (1) of subparagraph (b), of " sixty-two " for " sixty."

(2) Paragraph (1) of this Article shall operate with effect from the 29th day of December, 1951.

(3) An application to become pensionable under the said Order of 1951, if made within six months after the making of this Order by a person who is brought within the terms of the said Article 5 by virtue of the amendment effected by this Article, shall be deemed to have been duly made under the said Article 5.
