CLOTH, CLOTHING AND KNITTING WOOL (MAXIMUM PRICES) ORDER, 1947 (AMENDMENT) ORDER, 1952.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O., No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O., No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), and of every and any other power me in this behalf enabling, hereby order as follows :—

1.—(1) This Order may be cited as the Cloth, Clothing and Knitting Wool (Maximum Prices) Order, 1947 (Amendment) Order, 1952.

(2) This Order shall come into operation on the 7th day of July, 1952.

2. The Cloth, Clothing and Knitting Wool (Maximum Prices) Order, 1947 (S. R. & O., No. 323 of 1947), and this Order shall be construed together as one.

3. In calculating the appropriate wholesale or retail price of controlled articles, the provisions of the Cloth, Clothing and Knitting Wool (Maximum Prices) Order, 1947 (S. R. & O., No. 323 of 1947), shall not operate to prevent the averaging of prices of articles of the same description and of substantially the same quality, provided that the overall average wholesaler's or retailer's margin shall not exceed that specified in the Schedule to the said Order in respect of the articles concerned.

4. The Cloth, Clothing and Knitting Wool (Maximum Prices Order, 1947 (S. R. & O., No. 323 of 1947), is hereby amended—

(a) by the substitution for the definition of the expression " authorised officer " in paragraph (1) of Article 2 of the following :—

" the expression ' authorised officer ' means any person appointed by the Minister to be an authorised officer for the purposes of this Order " ; and

(b) by the deletion of paragraph (2) of Article 7, paragraph (3) of Article 8, paragraph (3) of Article 9 and Article 14.
