BUTTER (CONTROL IN SCHEDULED AREA) ORDER, 1952.

I, THOMAS WALSH, Minister for Agriculture, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O., No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O., No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)) and of every and any other power me in this behalf enabling, hereby order as follows:—

1.—(1) This Order may be cited as the Butter (Control in Scheduled Area) Order, 1952.

(2) This Order shall come into operation on the 5th day of July, 1952.

2. In this Order—

" the scheduled area " means the area specified in the Schedule to this Order;

" butter to which this Order applies " means any butter which is—

(a) creamery butter, that is to say, butter which has been manufactured in premises registered in the register of creameries kept under the Dairy Produce Act, 1924 (No. 58 of 1924), and has not been subsequently blended or re-worked, or

(b) imported butter;

" the Butter Marketing Committee " means the central marketing organisation operating under that name under rules approved by the Minister for Agriculture.

" catering establishment " means a restaurant, hotel, boarding house, guest house, lodging house, café, tea-room, canteen or club;

" institution " means a hospital, sanatorium, convalescent home, nursing home, school, college, convent, monastery, or any similar institution.

3. A person (other than the Butter Marketing Committee) shall not sell in the scheduled area any butter to which this Order applies unless the butter was supplied to him by the Butter Marketing Committee or by a person who obtained it from the Butter Marketing Committee.

4.—(1) Subject to paragraph (2) of this Article—

(a) a person shall not supply for sale in the scheduled area any butter to which this order applies, and

(b) a person shall not acquire for sale in the scheduled area any butter to which this Order applies.

(2) Paragraph (1) of this Article shall not apply where the butter in question is supplied by the Butter Marketing Committee or by a person who obtained it from the Butter Marketing Committee.

5. The proprietor of a catering establishment in the scheduled area or the head of an institution in that area shall not purchase any butter to which this Order applies unless he purchases it from the Butter Marketing Committee or from a person who obtained it from the Butter Marketing Committee.

SCHEDULE.

The area consisting of the county borough of Dublin, the administrative county of Dublin and the urban district of Bray.
