DISTRIBUTION OF HIDES AND SKINS ORDER, 1952.

I, PROINSIAS MAC AOGÁIN, Acting Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O., No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O., No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisians) Act, 1946 (No. 22 of 1946)), and of every and any other power me in this behalf enabling hereby order as follows :

1. This Order may be cited as the Distribution of Hides and Skins Order, 1952.

2. In this Order—

The expression " authorised officer " means a person who is an authorised officer for the purposes of the Emergency Powers (General Rationing Provisions) Order, 1944 (S. R. & O., No. 130 of 1944) ;

the word " hides " means the hides of cattle and horses ;

the word " licence " means a licence under Article 5 of this Order ;

the expression " the Minister " means the Minister for Industry and Commerce ;

the word " skins " means the skins of calves, veal, sheep and lambs, and includes kip.

3.—(1) No person shall acquire any hides or skins for tanning except under and in accordance with a licence granted or direction issued by the Minister.

(2) This Article does not apply to imported hides and skins.

4.—(1) Any person who carries on the business of tanning or proposes to carry on such business may apply to the Minister for a licence.

(2) Every application for a licence shall—

(a) be in writing,

(b) contain such particulars as the Minister may require,

(c) be sent to the Secretary, Department of Industry and Commerce, Dublin.

5. On receipt of an application duly made under Article 4 of this Order, the Minister may, in his absolute discretion, grant or refuse a licence.

6.—(1) Whenever the Minister grants a licence he may attach to the licence any one or more of the following conditions :—

(a) that the holder shall acquire only such hides and skins as may be directed to him from time to time by Associated Tanners of Ireland, Ltd. ;

(b) that the holder shall not tan any hides or skins on a commission basis ;

(c) that the holder shall retain the licence in safe custody and shall produce it or surrender it on demand being made by the Minister or by an authorised officer ;

(d) that, in the event of the loss or destruction of the licence the holder shall immediately so inform the Department of Industry and Commerce in writing ;

(e) such other conditions as the Minister thinks fit.

(2) The Minister may, by notice served on the holder of a licence—

(a) amend a condition attached to the licence ;

(b) attach a new condition to the licence, or

(c) revoke a condition attached to the licence.

(3) The holder of a licence shall comply with every condition attached thereto.

7. The holder of a licence shall keep at the premises in which he carries on the business of tanning such records as the Minister may from time to time require.

8. The Minister may by a special or general direction authorise any person or persons carrying on the business of tanning to acquire hides or skins on such conditions as may be set out in the direction.

9. An authorised officer may at all reasonable times enter and inspect the premises in which the holder of a licence carries on the business of tanning and may examine and take stock of any hides or skins which he finds on the premises.

10. The holder of a licence and any person employed by him shall—

(a) at the request of an authorised officer, produce to such officer any books, documents or records relating to the acquisition of hides or skins which are in the power, possession or procurement of such person, and permit such officer to inspect and take extracts from such books, documents or records, and give to such officer any information which he may reasonably require in regard to any entries therein,

(b) give to an authorised officer any information he may reasonably require in regard to any acquisition of hides or skins.

(c) afford to an authorised officer all reasonable facilities for the inspection and taking stock of any hides or skins on the premises of such holder.
