SECONDARY TEACHERS' SUPERANNUATION (AMENDMENT) SCHEME, 1952.

I, SEÁN MOYLAN, Minister for Education, with the consent of the Minister for Finance, testified by his signature hereto, in exercise of the powers conferred on me by the Teachers' Superannuation Act, 1928 (No. 32 of 1928), and of every and any other power me in this behalf enabling, do hereby make the following scheme, that is to say :—

1. This Scheme may be cited as the Secondary Teachers' Superannuation (Amendment) Scheme, 1952, and the Secondary Teachers' Superannuation Schemes, 1929 to 1951, and this scheme may be cited together as the Secondary Teachers' Superannuation Schemes, 1929 to 1952.

2.—(1) In this Scheme, the expression " the amending Scheme of 1951 " means the Secondary Teachers' Superannuation (Amendment) Scheme, 1951 ( S. I. No. 48 of 1951 ).

(2) The Secondary Teachers' Superannuation Schemes, 1929 to 1951, and this Scheme shall be construed together as one Scheme.

3. This Scheme shall come into force immediately upon its being confirmed by each House of the Oireachtas.

4. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Scheme.

5. The reference to one and one half per cent. in paragraphs 4 and 17 of the amending Scheme of 1951 shall be construed as a reference to one per cent. and accordingly any additional contributions in excess of one per cent. paid, whether before or after the commencement of this Scheme, by virtue of the said amending Scheme, by members or taken into account in computing awards made pursuant to paragraph 23 or 24 of that Scheme shall be refunded.

6. The reference to the 31st day of July, 1951, in paragraphs 5, 10, 11, 12, 15 and 24 of the amending Scheme of 1951, shall be construed as a reference to the 31st day of July, 1952.

7. Subparagraph (1) of paragraph 5 of the amending Scheme of 1951 is hereby amended by the substitution in clause (b) of " as from the first day on which he gave approved teaching service after the 31st day of July, 1929," for " as from the date on which he first entered approved teaching service ".

8. Paragraph 6 of the amending Scheme of 1951 is hereby amended by the substitution for subparagraph (1) of the following :

" (1) A future teacher who is a member and who was admitted to membership on an application made before the relevant date but who did not become such member as from the first day on which he gave approved teaching service after the 31st day of July, 1929, may, on renewed application for membership, made on or before the 31st day of July, 1952, have his membership ante-dated to such first day."

9. Paragraph 15 of the amending Scheme of 1951 is hereby amended by the addition of the following :

" (d) an ex-member who was not in approved teaching service on the 31st day of July, 1950, and who is re-admitted to membership subsequent to that date and who opts to pay a contribution of five per cent. per annum of his standard salary in respect of all his approved teaching service after that date."

10. Clause (a) of paragraph 16 of the amending Scheme of 1951, is hereby amended by the substitution of " before the 1st day of August, 1952," for " before the 31st day of July, 1951,".

11. Paragraph 17 of the amending Scheme of 1951 is hereby amended by the addition to clause (b) of the following :

" provided he pays each such contribution within ten years from the date on which particulars of the amount of his additional contributions are sent to him or within such shorter period as may be fixed by the Minister,".

12. Paragraph 19 of the amending Scheme of 1951 is hereby amended by the addition of the following :

" (4) In the event of the death of a person to whom this Part of this Scheme applies, who has not completed five years gratuity service, a gratuity, equal to the amount of his contributions to the pension fund, shall be paid out of the pension fund to his legal personal representative and, on such payment, there shall be paid to the Minister out of the pension fund a sum equal to the amount of the payment (if any) made by the Minister into the pension fund in respect of such person."

13. Paragraph 22 of the amending Scheme of 1951 is hereby amended by the insertion of " or after " immediately before " that date ".
