EMERGENCY POWERS (No. 358) ORDER, 1945 (AMENDMENT) ORDER, 1950.

The Government, in exercise of the powers conferred on them by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946), hereby order as follows :—

1. This Order may be cited as the Emergency Powers (No. 358) Order, 1945 (Amendment) Order, 1950.

2. In this Order—

the word " house " means a building or any part of a building suitable for occupation as a dwelling-house ;

the expression " building operation to which this Order applies " means any operation (including painting and the provision of water, light, heating or other services) in connection with the construction of a house ;

the expression " local authority " means the council of a county, the corporation of a county or other borough, the council of an urban district or the commissioners of a town.

3. The Emergency Powers (No. 358) Order, 1945 (S. R. & O., No. 103 of 1945), shall not apply in relation to a building operation to which this Order applies if—

(a) such operation is executed either by a local authority on their own behalf or by a person on behalf of a local authority, or

(b) such operation being not so executed, the floor area of the house does not exceed 1,400 square feet.

4. For the purposes of paragraph (b) of Article 3 of this Order—

(a) the floor area of a house shall be the sum of the areas of every floor,

(b) the area of any floor shall be measured within the external or containing walls of the house, and shall include any portion of such floor which is occupied by staircases, landings, interior walls, chimney breasts, bay-windows, and similar spaces and structures.

5. The Emergency Powers (No. 358) Order, 1945 (Amendment) Order, 1949 ( S. I. No. 16 of 1949 ), is hereby revoked.
