Change in constitution of Appeal Tribunal.

14.—(1) The Minister, after consultation with the Judicial Commissioner, may by order appoint a day to be the appointed day for the purposes of this section and the day so appointed shall be a day not earlier than two months after the day on which such order is made.

(2) On and after the appointed day, the following provisions shall have effect:—

(a) the Appeal Tribunal shall consist of the Judicial Commissioner only;

(b) section 7 of the Land Act, 1933 , shall stand amended—

(i) by the deletion in sub-section (1) of the words “and two Lay Commissioners nominated for the purpose by the Executive Council”, and

(ii) by the deletion of sub-sections (2), (3), (4) and (5);

(c) the expression “Lay Commissioners (other than the members of the Appeal Tribunal)”, wherever it occurs in the Land Act, 1936 , or the Land Act, 1939 , shall stand amended by the deletion of the words “(other than the members of the Appeal Tribunal)”.

(3) Where a Lay Commissioner has, consequent on the foregoing provisions of this section, ceased to be a member of the Appeal Tribunal, he shall, subject to section 16 of this Act, hold his office as a Lay Commissioner by the same tenure as a Judge of the Circuit Court holds his office as such Judge.
