NATIONAL HEALTH INSURANCE (APPROVED SOCIETIES) (AMENDMENT) REGULATIONS, 1949.

The Minister for Social Welfare, in exercise of the powers conferred on him by the National Health Insurance Acts, 1911 to 1948, and of every and any power him in this behalf enabling, by this his Order, makes the following Regulations:—

1. These Regulations may be cited as the National Health Insurance (Approved Societies) (Amendment) Regulations, 1949.

2. In these Regulations—

" the Society " means Cumann an Árachais Náisiúnta ar Shláinte;

" the principal Regulations " means the National Health Insurance (Approved Societies) Consolidated Regulations, 1918 to 1946;

" the second additional benefit period " means the quinquennial period ending on the 31st day of March, 1952.

3. The Schedule to these Regulations shall be substituted for the Second Schedule to the principal Regulations and Article 46 of the principal Regulations shall have effect accordingly.

4. Notwithstanding anything contained in paragraph (1A) of Article 46 of the principal Regulations the sum to be debited annually to the Account kept by the Society in relation to the second additional benefit period in respect of any additional benefit and credited to the Administration Account in respect of each of the years 1947 to 1952, inclusive, shall be a sum of one quarter of one per cent. of the net amount paid by the Society during that year out of sums available for the provision of that additional benefit.

5. The following Article shall be substituted for Article 224 of the principal Regulations:—

"224—(1) For the purposes of sub-section (1) of Section 7 of the Act of 1918 the time within which a person who is entitled to become a voluntary contributor may give notice of desire to become such a voluntary contributor, shall be the period during which, after ceasing to be employed within the meaning of the principal Act, he continues to be insured under that Act, or such longer period as the Minister, having regard to the circumstances of the particular case, may allow.

"(2) Notice of desire to become a voluntary contributor in pursuance of sub-section (1) of Section 7 of the Act of 1918 shall be given in writing to the Society and such particulars shall be furnished in relation thereto as the Society may require."

6. The National Health Insurance (Approved Societies) Amendment Regulations, 1930, are hereby revoked.

7.—(1) These Regulations shall be construed as one with the principal Regulations.

(2) The principal Regulations and these Regulations may be cited together as the National Health Insurance (Approved Societies) Consolidated Regulations, 1918 to 1949.

SCHEDULE.

METHOD OF CALCULATING THE MAXIMUM SUM.

(1) For the purpose of this Schedule the number of persons who are members of the Society during the year 1947 and any subsequent year shall be ascertained, in such manner as the Minister for Social Welfare may direct, by reference to the number of contribution cards claimed by the Society in its return relating to the contribution year ending in such year and to the mean number of members of the Defence Forces for whom contributions in respect of National Health Insurance are paid by the Minister for Defence in the year in question.

(2) The maximum sum which may be carried to the administration account of the Society for the year 1947 and any subsequent year out of contributions payable under the principal Act shall be an amount obtained by multiplying the number of members of the Society by the sum of five shillings and sixpence.

(3) In this Schedule " member " does not include a member who is of the age of seventy or upwards.
