FLOUR AND BREAD (RATIONING) ORDER, 1946 (SIXTH AMENDMENT) ORDER, 1949.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), hereby order as follows :

1.—(1) This Order may be cited as the Flour and Bread (Rationing) Order, 1946 (Sixth Amendment) Order, 1949.

(2) This Order shall, save as otherwise provided therein, come into operation on the 21st day of May, 1949.

2. In this Order, the expression " the Principal Order " means the Flour and Bread (Rationing) Order, 1946 ( S. R. & O. No. 388 of 1946 ), as amended by subsequent Orders.

3. The Principal Order shall not apply in relation to any flour confectionery or any bread which is not bread sold in units of one pound or multiples of one pound in weight.

4. Each of the forms set out in the Schedules to this Order is hereby substituted for the form set out in the corresponding Schedule to the Principal Order.

5.—(1) Article 38 of the Principal Order is hereby amended—

(a) by the substitution in paragraphs (1), (2), (5) and (6) of the word " wheatmeal " for the words " flour confectionery " wherever the latter words occur, and

(b) by the deletion of paragraphs (3) and (4).

(2) Where—

(a) a transaction such as is referred to in sub-paragraph (b) or (c) of paragraph (5) of Article 38 of the Principal Order is effected after the commencement of this Article, and

(b) a coupon or coupons is or are surrendered in relation to the transaction and the coupon or coupons is or are such as would authorise the transaction if paragraph (1) of this Article were not in force.

the transaction shall, notwithstanding paragraph (1) of this Article, be deemed to be duly authorised.

(3) This Article shall come into force on the 28th day of May, 1949.

INSTRUCTIONS.

Note :— " Flour " includes " Wheatenmeal."

(1) Each registration page lodged with you for flour entitles you to apply for one half of the standard ration of flour per week as announced from time to time.

(2) The total quantity of flour with which you require to be supplied per week for your retail trade must not exceed one half of the standard ration multiplied by the number of registration pages lodged with you for flour.

(3) If you wish to deal for flour with more than one supplier, you must complete a separate certificate for each supplier, but whether you elect to deal with one or more suppliers, the total weekly quantity of flour which you are entitled to purchase for your registered domestic consumers must not exceed the quantity ascertained as at (2) above.

(4) Post the certificate (or certificates) to the supplier (or suppliers) from whom you ordinarily purchase flour. Send a copy of each certificate to the Department of Industry and Commerce (Flour and Bread Rationing Section), Dublin.

(5) This Form is to be used for your retail trade only. If you are also a flour wholesaler, you must use Form F.B.R. 2 to get supplies for your wholesale trade. If you are also a Baker, you must use Form F.B.R. 5 to get supplies of flour for your Bakery.

(6) This Form is to be used for Flour only. If you require supplies of bread for your retail trade, use Form F.B.R. 3.

(7) Separate Forms must be used for each establishment where flour is sold retail.

(8) If at any time there is a reduction in the number of domestic consumere registered with you for flour, you must at once instruct your suppliers to reduc your supplies accordingly and forward a copy of the instruction to the Department of Industry and Commerce.

(2) If you wish to deal for flour with more than one supplier, you must complete a separate certificate for each supplier, but whether you elect to deal with one or more suppliers, the total weekly quantity which you are entitled to purchase for sale by wholesale must not exceed the total weekly quantity ordered from you on your trader customers' certificates.

(3) Post your certificate (or certificates) to the supplier (or suppliers) from whom you purchase flour. Send a copy of each of your certificates to the Department of Industry and Commerce (Flour and Bread Rationing Section), Dublin.

(4) All certificates lodged with you by your trader customers must be retained by you and made available for official inspection when required.

(5) This Form is to be used for your wholesale trade only. If you are also a flour retailer, you must lodge with your suppliers Form F.B.R.1., to get supplies for your retail trade. If you are also a Baker, you must lodge with your suppliers Form F.B.R. 5, to get supplies of flour for your Bakery.

(6) This Form is to be used for flour only. If you are also a wholesaler of bread, and not a Baker, you must lodge with your suppliers Form F.B.R. 4, to get supplies of bread.

INSTRUCTIONS.

(1) Each registration page lodged with you for bread entitles you to apply for one half of the standard ration of flour per week.

(2) You are also entitled to apply for flour to bake sufficient bread to meet the weekly requirements of the trader customers who have lodged certificates in forms F.B.R. 3, or F.B.R. 4, with you as well as the weekly requirements of the holders of Food Vouchers issued by Local Authorities.

(3) Flour for the manufacture of bread to meet the requirements of customers who have lodged Permit Vouchers or Food Ration Cards with you should not be requisitioned on this form.

(4) If you wish to deal for flour with more than one supplier, you must complete a separate certificate for each supplier. Whether you elect to deal with one or more suppliers, the total weekly quantity which you are entitled to purchase for your bakery must not exceed the quantity sufficient to enable you to meet all the legitimate demands on you for bread.

(5) Post your certificate (or certificates) to the supplier (or suppliers) from whom you purchase flour. Send a copy of each of your certificates to the Department of Industry and Commerce (Flour and Bread Rationing Section), Dublin.

(6) This Form is to be used to obtain supplies for your Bakery only. If you are also a retailer of flour, you must lodge with your suppliers Form F.B.R. 1, to get supplies for your retail trade. If you are also a wholesaler of flour, you must lodge with your suppliers Form F.B.R. 2, to get supplies for your wholesale trade.

(7) Separate forms must be used for each establishment where the business of baking is carried on.

(8) If at any time there is a reduction in the total demands for bread made upon you, you must at once instruct your suppliers to reduce your flour supplies accordingly and forward a copy of the instruction to the Department of Industry and Commerce.

(4) The quantity of bread with which you require to be supplied each week for the holders of Food Vouchers must not exceed your normal weekly sales to such holders.

(5) If you wish to deal for bread with more than one supplier you must complete a separate certificate for each supplier. Whether you elect to deal with one or more suppliers the total weekly quantity of bread which you are entitled to purchase for your registered domestic consumers and holders of Food Vouchers must not exceed the quantity ascertained as at (2) and (4) above.

(6) Post this certificate or certificates to the supplier (or suppliers) from whom you ordinarily purchase bread. Send a copy of each certificate to the Department of Industry and Commerce (Flour and Bread Rationing Section), Dublin.

(7) This Form is to be used for your retail trade only. If you are also a Bread Wholesaler and not a baker you must use Form F.B.R. 4, to get supplies for your wholesale trade.

(8) This Form is to be used for bread only. If you require supplies of flour for your retail trade, use Form F.B.R. 1.

INSTRUCTIONS TO RETAILERS :

1. The retailer must insert his name and address in the space provided at the head of the form.

2. The particulars required in Column 2, Part I, must be inserted within 3 days after the commencement of each week.

3. The particulars required in the other columns of Part I must be inserted within 3 days after the end of each week.

4. The particulars required in Part II of the Form must be recorded immediately on receipt of each Permit Voucher and before the Voucher is passed to the wholesaler supplier.
