RIVER FOYLE (FISHING BY HOLDERS OF SPECIAL LOCAL LICENCES) REGULATIONS, 1949.

WHEREAS it is enacted by sub-section (1) of Section 8 of the Fisheries (Tidal Waters) Act, 1934 (No. 24 of 1934), that the Minister for Agriculture may by order make regulations in relation to all or any of the following matters, that is to say :—

(a) the times and the places at which holders of special local licences may fish under such licences respectively ;

(b) the keeping of order among holders of special local licences at or on the particular tidal waters to which such licences relate.

NOW, THEREFORE, I, JAMES M. DILLON, Minister for Agriculture, in exercise of the powers conferred on me by subsection (1) of Section 8 of the Fisheries (Tidal Waters) Act, 1934 (which Act is continued in force by the Fisheries Act, 1939 (No. 17 of 1939) ), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations :—

1. (1) These Regulations may be cited as the River Foyle (Fishing by Holders of Special Local Licences) Regulations, 1949.

(2) These Regulations shall come into operation on the 25th day of April, 1949.

(2) In these Regulations—

the expression " licensee " means the holder of a Special Local Licence issued in respect of the tidal waters of the River Foyle as defined in the River Foyle (Tidal Waters) Order, 1949 ( S.I. No. 103 of 1949 ) ;

the expression " fishing station " means any place within the tidal waters of the River Foyle as defined in the River Foyle (Tidal Waters) Order, 1949 ( S.I. No. 103 of 1949 ) at which a licensee shoots and hauls a draft net and includes the area within 100 yards at either side of such place.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. Every licensee using a draft net for the capture of salmon or trout in the tidal waters of the River Foyle as defined in the River Foyle (Tidal Waters) Order, 1949 ( S.I. No. 103 of 1949 ), shall observe strictly the following procedure—

(a) A licensee using a draft net in the fishing waters on completing the hauling thereof at any fishing station shall not again shoot such net at that station until every other licensee who may be waiting to fish at such station shall have shot and hauled his draft net.

(b) A licensee shall not be permitted to occupy for more than one hour any fishing station in the fishing waters at which other licensees are awaiting their turns to fish.
