EMERGENCY POWERS (JAMS AND MARMALADES) (MAXIMUM PRICES) ORDER, 1944 (AMENDMENT) (NO. 4) ORDER, 1949.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the
Supplies and Services (Temporary Provisions) Act, 1946
(No. 22 of 1946) as amended by the
Supplies and Services (Temporary Provisions) Act, 1946
(Continuance) Act, 1948 (No. 18 of 1948)), and of every and any other power me in this behalf enabling, hereby order as follows :—
1.—(1) This Order may be cited as the Emergency Powers (Jams and Marmalades) (Maximum Prices) Order, 1944 (Amendment) (No. 4) Order, 1949.

(2) This Order shall come into operation on the 14th day of February, 1949.
2. Emergency Powers (Jams and Marmalades) (Maximum Prices) Order, 1944 (Amendment) (No. 3) Order, 1947 (S. R. & O. No. 232 of 1947) is hereby revoked.
3. For the purpose of this Order, any fraction of a halfpenny shall be regarded as one halfpenny.
4. The Emergency Powers (Jams and Marmalades) (Maximum Prices) Order, 1944 (S. R. & O. No. 154 of 1944) is hereby amended—

(1) by the deletion of Article 6 and the substitution therefor of the following :—
6. No person shall sell by wholesale any jam or marmalade at a price exceeding—
|
| |
(a) in the case of jam or marmalade, the maximum retail price of which is marked under this Order on the containers or labels affixed to the containers, a price calculated at the rate of maximum wholesale price determined in respect of the jam or marmalade by the manufacturer thereof in accordance with the relevant direction of the Minister, and
|
| |
(b) in any other case a price calculated at the appropriate rate of maximum wholesale price indicated in respect of the jam or marmalade in the Schedule to this Order.
|
| |
(2) by the deletion of Article 10 and the substitution therefor of the following :—
|
| |
10. Where any jam or marmalade is sold on condition that the purchaser delivers empty containers to the vendor, the vendor shall, in calculating the price of the jam or marmalade, make an allowance for each container so delivered according to its size as follows :—
