EMERGENCY POWERS (SCUTCHING OF FLAX) ORDER, 1948.

I, JAMES M. DILLON, Minister for Agriculture, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), and of every and any other power me in this behalf enabling, hereby order as follows :—

1. This Order may be cited as the Emergency Powers (Scutching of Flax) Order, 1948.

2. In this Order the expression " the Scheduled area " means the areas specified in the Schedule to this Order.

3. Each of the following persons shall be an authorised officer for the purposes of this Order :

(a) any person appointed by the Minister for Agriculture to be an authorised officer for the purposes of this Order,

(b) any officer of the said Minister.

4. Where a person carrying on a flax scutch mill in the Scheduled area scutches flax for any other person, he shall not retain any tow yielded in the scutching unless—

(a) such other person agrees to his retaining the tow in part payment of the charge for scutching, or

(b) such other person agrees to sell the tow to him at an agreed price, or

(c) he accepts the tow for further scutching and agrees to return it when scutched to such other person or to sell it on behalf of such other person.

5. Where a person carrying on a flax scutch mill in the Scheduled area scutches flax for any other person—

(a) if the tow yielded in the scutching is retained in part payment of the charge for the scutching—the charge for the scutching shall not exceed four shillings and three pence per stone of scutched fibre produced ;

(b) in any other case—the charge for the scutching shall not exceed five shillings and nine pence per stone of scutched fibre produced.

6. Where a person carrying on a flax scutch mill in the Scheduled area scutches tow for any other person the charge for the scutching shall not exceed four shillings and three pence per stone of scutched tow produced.

7. Every person who carries on, or is employed, in connection with a flax scutch mill in the Scheduled area is hereby required, from time to time—

(a) to produce, at the request of an authorised officer, to such officer any books, records, or documents relating to the scutching of flax or tow in the mill which are in the power, possession, or procurement of such person, to permit such officer to inspect and take extracts from such books, records or documents, and to give to such officer any information which he may reasonably require in regard to any entries therein,

(b) to afford to an authorised officer all reasonable facilities for the inspection of any flax or tow stored in the mill or in any building or place used in connection with the mill.

8. An authorised officer may, in the Scheduled area, at all reasonable times enter on any flax scutch mill or any building or place used in connection with such mill and may inspect any flax or tow stored therein.
