MOLASSED SUGAR BEET PULP (MAXIMUM PRICES) ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939) as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946) as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947 (No. 39 of 1947)) and of every and any other power me in this behalf enabling, hereby order as follows :—

1.—(1) This Order may be cited as Molassed Sugar Beet Pulp (Maximum Prices) Order, 1948.

(2) This Order shall come into operation on the 1st day of October, 1948.

2. In this Order—

the expression " the Minister " shall mean the Minister for Industry and Commerce ;

the word " pulp " shall mean molassed sugar beet pulp.

3. References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

4.—(1) No person shall sell pulp at a price exceeding a price calculated at the rate of £7 15s. 0d. per ton provided that in the case of a sale by a sugar beet grower or a sugar beet seed grower of special pulp which has been purchased by him direct from Comhlucht Siuicre Eireann Teoranta, the price calculated as aforesaid may be increased by the appropriate amount.

(2) In this Article—

the expression " special pulp " shall mean pulp which has been purchased by a sugar beet grower or sugar beet seed grower from Comhlucht Siuicre Eireann Teoranta by virtue of his sugar beet growing or sugar beet seed growing contract with that Company and which has been delivered from the factory of Comhlucht Siuicre Eireann Teoranta to the premises of such grower ;

the expression " the appropriate amount " shall mean in relation to the sale of any pulp an amount not exceeding the lowest cost of delivery of such pulp by public transport fromthe factory of Comhlucht Siuicre Eireann Teoranta where it was produced to the premises of the person making such sale.

5. Where a direction is given by the Minister in respect of any particular person or group of persons or in respect of any particular pulp the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction.

6. Emergency Powers (Molassed Sugar Beet Pulp) (Maximum Prices) Order, 1945 (S. R. & O. No. 281 of 1945) is hereby revoked.
