TEA (MAXIMUM PRICES) (No. 2) ORDER, 1947 (AMENDMENT) (No. 4) ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942), (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946), as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947 (No. 39 of 1947)) and of every and any other power me in this behalf enabling, hereby order as follows :—

1.—(1) This Order may be cited as the Tea (Maximum Prices) (No. 2) Order, 1947 (Amendment) (No. 4) Order, 1948.

(2) This Order shall come into operation on the 16th day of September, 1948.

2.—(1) In this Order—

the expression " the Principal Order " means the Tea (Maximum Prices) (No. 2) Order, 1947 ( S. R. & O. No. 343 of 1947 ) ;

the expression "catering establishment " has the meaning attached to it by the Distribution of Tea to Catering Establishments (No. 2) Order, 1948 ( S.I. No. 228 of 1948 ).

(2) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. Article 3 and Article 4 of the Principal Order shall not apply to tea which has been supplied by Tea Importers, Ltd. under the provisions of the Distribution of Tea to Catering Establishments (No. 2) Order, 1948 ( S.I. No. 228 of 1948 ) for use in a catering establishment on or after the 1st August, 1948.

4. No person shall sell tea which has been supplied by Tea Importers, Ltd., under the provisions of the Distribution of Tea to Catering Establishments (No. 2) Order, 1948 ( S.I. No. 228 of 1948 ) for use in a catering establishment on or after the 1st August, 1948, at a price exceeding a price calculated at whichever of the following rates is appropriate :—

(a) When sold by wholesale

4/5½d. per lb. delivered to the retailer.

(b) When sold by retail

5/- per lb.

5. The Tea (Maximum Prices) (No. 2) Order, 1947 (Amendment) (No. 2) Order, 1948 ( S.I. No. 250 of 1948 ) is hereby revoked.
