UNEMPLOYMENT INSURANCE ACT, 1946 (AMENDMENT OF PART II) REGULATIONS, 1948.

WHEREAS it is enacted by section 12 of the Unemployment Insurance Act, 1946 (No. 37 of 1946), as adapted by the Social Welfare (Transfer of Departmental Administration and Ministerial Functions) (No. 1) Order, 1947 ( S. R. & O. No. 18 of 1947 ), that, if the arrangements referred to in the said section are modified at any time after the commencement of Part II of the said Act, the Minister for Social Welfare may by regulations under the said Act make such amendments of the said Part II as are in his opinion necessary for giving effect to the said arrangements as so modified :

AND WHEREAS Part II of the said Act came into operation on the 27th day of February, 1947, and the said arrangements were modified after that date :

NOW, I, WILLIAM NORTON, Minister for Social Welfare, in exercise of the power conferred on me by section 12 of the Unemployment Insurance Act, 1946 (No. 37 of 1946), as adapted by the Social Welfare (Transfer of Departmental Administration and Ministerial Functions) (No. 1) Order, 1947 ( S. R. & O. No. 18 of 1947 ), hereby make the following regulations :—

1.—(1) These Regulations may be cited as the Unemployment Insurance Act, 1946 (Amendment of Part II) Regulations, 1948.

(2) These Regulations shall come into operation on the 5th day of July, 1948.

2. In these Regulations, the expression " the Act " means the Unemployment Insurance Act, 1946 .

3.—(1) The section of the act mentioned in column (2) of the Schedule hereto at any reference number is hereby amended in the manner set out in column (3) of the said Schedule at that reference number.

(2) In the amendments of the act effected by paragraph (1) of this Regulation—

the expression " the British Act " means the British National Insurance Act, 1946 :

the expression " the British National Insurance Fund " means the Fund established under the British Act.

Section 5

By the deletion of paragraph (e) and the substitution therefor of the following paragraph—

" (e) had, in respect of service in the said Forces in respect of the two years immediately preceding the date of his first claim for special benefit, either not less than thirty contributions credited to him in the British Unemployment Fund or a number of such contributions which added to the number of contributions paid into the British National Insurance Fund amounts to an aggregate of not less than thirty or has not less than thirty contributions paid into the British National Insurance Fund ".

By the deletion of paragraph (h) and the substitution therefor of the following paragraph—

" (h) has not received special benefit in respect of the number of days which may, under subsection (2) of section 6 of this Act, be paid to him."

Section 6

By the deletion of subsection (1) and the substitution therefor of the following subsection—

" (1) (a) Subject to paragraph (b) of this subsection, special benefit payable to any person entitled thereto shall be at the weekly rate which is as respects that person the appropriate weekly rate of unemployment benefit under the British Act.

(b) Where a person entitled to special benefit has—

(i) a dependant, other than a dependent child, within the meaning of the Irish Acts, the weekly rate of special benefit of that person shall be increased by an amount equal to the amount payable under the British Act as an increase of unemployment benefit in respect of an adult dependant,

(ii) a dependent child, within the meaning of the Irish Acts, the weekly rate of special benefit shall be increased by a sum of five shillings in respect of that child,

(iii) two or more dependent children, within the meaning of the Irish Acts, the weekly rate of special benefit shall

be increased by a sum of five shillings in respect of the first such child and a sum of three shillings in respect of the second such child ".

By the deletion of paragraph (a) of subsection (2) and the substitution therefor of the following paragraph—

" (a) Special benefit shall not be payable to any one person in respect of more than one hundred and eighty days ".

By the deletion of subsection (3).

Section 9

By the deletion in subsection (40) of the words " British Unemployment Fund " and the substitution therefor of the words " British National Insurance Fund ".

4.

Section 14

By the deletion in subsection (1) of the words " British Unemployment Fund " and the substitution therefor of the words " British National Insurance Fund ".
