SUGAR (MAXIMUM PRICES) (No. 3) ORDER, 1947 (AMENDMENT) (No. 1) ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946), as amended by the Supplies and Services (Temporary Provisions) Act, 1946 (Continuance) Act, 1947 (No. 39 of 1947)) and of every and any other power me in this behalf enabling, hereby order as follows :—

1. This Order may be cited as the Sugar (Maximum Prices) (No. 3) Order, 1947 (Amendment) (No. 1) Order, 1948.

2. (1) In this Order—

the expression " the Principal Order " means the Sugar (Maximum Prices) (No. 3) Order, 1947 ( S. R. & O. No. 344 of 1947 ) ;

the expression " catering establishment " has the meaning attached to it by the Emergency Powers (Sugar) Order, 1943 (S. R. & O. No. 90 of 1943) ;

the word " delivery " and the expression " sugar permit " have the meanings attached to them by the Principal Order.

(2) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. Article 3 and Article 4 of the Principal Order shall not apply to sugar which has been authorised to be purchased for the month of June, 1948, or for any subsequent month under a sugar permit granted to a catering establishment.

4. No person shall sell sugar which has been authorised to be purchased for the month of June, 1948, or for any subsequent month under a sugar permit granted to a catering establishment at a price exceeding a price calculated at whichever of the following rates is appropriate :—

(a) When sold by wholesale on or after the 20th day of May, 1948—53/8 per cwt. including delivery in the case of sugar sold in quantities of 1 cwt. and upwards.

(b) When sold by retail on or after the 1st day of June, 1948— 6¼d. per lb.
