EMERGENCY POWERS (BUTTER) (LICENSING OF WHOLESALERS AND RETAILERS) ORDER, 1943 (AMENDMENT) ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), hereby order as follows :—

1. This Order may be cited as the Emergency Powers (Butter) (Licensing of Wholesalers and Retailers) Order, 1943 (Amendment) Order, 1948.

2. In this Order—

the word " creamery " means premises registered in the Register of Creameries kept under the Dairy Produce Act, 1924 (No. 58 of 1924), or in premises the subject of a license under section 42 of that Act ;

the expression " creamery butter " means butter which has been manufactured in a creamery, including any such butter which has been reworked or blended ;

the expression " non-creamery butter " means butter other than creamery butter.

3. (1) The Emergency Powers (Butter) (Licensing of Wholesalers and Retailers) Order, 1943 (S. R. & O. No. 196 of 1943), shall cease to apply in relation to non-creamery butter.

(2) For the purpose of giving effect to the foregoing paragraph of this Article—

(i) Article 11 of the Emergency Powers (Butter) (Licensing of Wholesalers and Retailers) Order, 1943, is hereby revoked,

(ii) references to butter in that Order shall be construed as references to creamery butter.
