TRANSPORT ACT, 1944 (ALTERATION OF MAXIMUM RAILWAY CHARGES OF THE LONDONDERRY AND LOUGH SWILLY RAILWAY COMPANY) ORDER, 1948.

I, DANIEL MORRISSEY, Minister for Industry and Commerce, in exercise of the powers conferred on me by Section 89 of the Transport Act, 1944 (No. 21 of 1944) hereby order as follows :—

1. This Order may be cited as the Transport Act, 1944 (Alteration of Maximum Railway Charges of the Londonderry and Lough Swilly Railway Company) Order, 1948.

2. The maximum charges applicable to the Londonderry and Lough Swilly Railway Company for traffic by rail are hereby altered in accordance with the Schedule to this Order and the altered charges shall come into operation on the 3rd day of May, 1948.

SCHEDULE

PART I.

Maximum railway charges applicable to the Londonderry and Lough Swilly Railway Company as modified and set out in the under-mentioned pages of the Order of the Court of the Railway Tribunal dated the 24th June, 1940, under the provisions of Section 31 of the Railways Act, 1924 , to be altered as follows :—

Page 1.

Charges in respect of distances 1 to 25 miles (both inclusive) to be increased by twelve per cent, subject to the Condition shown below.

Page 2.

Charges per cwt. for any distance not exceeding 25 miles under the following headings, vis.,

(a) General Scale ;

(b) Returned empty carboys or crates (other than Glass Manufacturers' crates and crates taken to pieces and so packed) ;

(c) Returned empty Fish packages;

(d) Brewers' returned empties ;

to be increased by twelve per cent. subject to the Condition shown below. Existing minimum charges remain unaltered.

Condition referred to above :—

In determining the amount to be added to the existing maximum charge fractions of one penny if less than one-half to be dropped and if one-half or more to be charged as one penny.

Substitution for the appropriate maximum railway charges in operation immediately prior to the date upon which this Order shall take effect of the altered maximum railway charges as set out hereunder :—
