EGGS (MAXIMUM PRICES) ORDER, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)) and of every and any other power me in this behalf enabling, hereby order as follows:—

1. (1) This Order may be cited as the Eggs (Maximum Prices) Order, 1947.

(2) This Order shall come into operation on the 3rd day of November, 1947.

2. (1) References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

(2) References in this Order to buying shall be construed as including references to agreeing or offering to buy or to inviting an offer to sell.

3. For the purpose of this Order, every word and expression to which a particular meaning is given by the Agricultural Produce (Eggs) Regulations, 1939 to 1945, shall in this Order have the meaning so given to it.

4. (1) No person shall sell eggs of any of the descriptions mentioned in the Schedule to this Order at any reference number at a price exceeding a price calculated at the appropriate rate mentioned in the said Schedule opposite such reference number.

(2) No wholesale merchant or retail merchant shall buy eggs of any of the descriptions mentioned in the Schedule to this Order at a price exceeding a price calculated at the appropriate rate set out in Column (3) of the said Schedule opposite such description.

(3) This Article shall not apply to eggs sold, for the purpose of hatching, by a person other than a wholesale merchant or a retail merchant.

5. The prices set out in column (3) of the Schedule to this Order shall be deemed for the purpose of the Order to include the cost of delivery.

6. Where any two or more of the descriptions of eggs mentioned in the Schedule to this Order are sold mixed, the price to be charged for such mixed descriptions shall not, in the aggregate, exceed an amount equivalent to the amount which could be charged if each such description was sold separately, but shall not in any event exceed a price calculated at the rate of 3/11 per dozen in the case of a sale to a retail merchant or 4/4 per dozen in the case of sale by retail.

7. For the purpose of this Order any fraction of a farthing shall be regarded as one farthing, provided that, where any two or more descriptions of eggs are sold mixed, this Article shall apply only to the total price to be charged for such mixed descriptions.

8. Where a direction is given by the Minister for Industry and Commerce in respect of any particular person or group of persons or in respect of any particular eggs or classification of eggs, the provisions of this Order shall, if and in so far as they are inconsistent with such direction, have effect subject to such direction.
