STATUTORY RULES AND ORDERS. 1947. No. 299.REGULATIONS, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by the Register of Population Order, 1947 (S. R. & O., No. 295 of 1947) and of every and any other power me in this behalf enabling, hereby make the following regulations:—

1. These Regulations may be cited as the Register of Population Order, 1947, Regulations, 1947.

2. In these Regulations—

the expression " the Register " means the Register of Population mentioned in the Register of Population Order, 1947 ;

the word " returns " means the returns required by these Regulations ;

the expression " authorised person " means a person appointed under paragraph 3 or paragraph 4 of these Regulations ;

the expression " the appointed time " means midnight on Monday, the 29th day of September, 1947.

3.—(1) The Commissioner of the Gárda Síochána may appoint such and so many persons (being members of the Gárda Síochána) as he thinks fit to be authorised persons for the purpose of these Regulations, and the appointment of persons under this paragraph may be made by their names or by the designation of their offices or in such other distinguishing manner as the said Commissioner thinks fit.

(2) There shall be issued to every authorised person appointed under this paragraph a certificate signed by an Officer of the Gárda Síochána, not below the rank of Superintendent, certifying that such person has been so appointed.

(3) A member of the Gárda Síochána who, while wearing his uniform as such member, produces a certificate under this paragraph to the effect that he has been appointed an authorised person shall, until the contrary is proved, be deemed to be an authorised person.

4.—(1) The Minister for Posts and Telegraphs may appoint such and so many persons, serving in the Department of Posts and Telegraphs, as he thinks fit to be authorised persons in the Dublin Metropolitan Gárda District for the purposes of these Regulations and the appointment of persons under this paragraph may be made by their names or by the designation of their offices or in such other distinguishing manner as the said Minister thinks fit.

(2) There shall be issued to every authorised person appointed under this paragraph a certificate signed by an officer of the Department of Posts and Telegraphs, not below the rank of Superintendent, certifying that such person has been so appointed.

(3) An official of the Department of Posts and Telegraphs who, while wearing his uniform as such official, produces a certificate under this paragraph to the effect that he has been appointed an authorised person shall, until the contrary is proved, be deemed to be an authorised person.

5. Every authorised person when acting under these Regulations shall on demand produce and show the certificate issued to him under these Regulations.

6. The particulars (in these Regulations referred to as the prescribed particulars) to be entered in the Register in relation to each person registered therein shall be the following :—

(a) name and address at the appointed time ;

(b) sex ;

(c) birthday and year of birth ;

(d) in respect of persons aged 16 years or over, whether single, married or widowed, at the appointed time.

7. On the 30th day of September, 1947, returns stating the prescribed particulars shall be made with respect to the several classes of persons in the State mentioned in the first column of the Schedule hereto by the person set out opposite each such class in the second column of the said Schedule, and each such return shall be in such form as the Minister may direct, be signed by the person by whom it is made, and be delivered to an authorised person on his calling to collect it.

8. Where an authorised person collecting a return is not satisfied that the entries thereon are properly and sufficiently made he shall make all necessary enquiries and make such corrections in the return as appear to him to be requisite, and for this purpose every person shall give to the said authorised person such information as the said authorised person may reasonably require.

Persons present at the appointed time in a dwelling, lodging or rooms, separately occupied by any private household of which they are members, guests (including paying guests or boarders) or employees or in married quarters occupied by members of the Defence Forces.

The head or other person for the time being acting as the head of the household.

Members of the Defence Forces and Civil personnel present at the appointed time, in any barrack, camp or post, excluding married quarters occupied by members of the Defence Forces.

The Officer Commanding or in charge for the time being of the barrack, camp or post.

Persons present at the appointed time, on the premises of the hotel, club, boarding house or common or other lodging house.

The manager or other person for the time being in charge of the premises.

Persons present at the appointed time on premises of any public or private hospital, sanatorium, convalescent or nursing home, county home, mental hospital, institution, religious or charitable community, residential school or college, or residential institution of any other kind.

The chief resident officer or other person for the time being in charge of the institution.

Persons present at the appointed time on any ship, boat, barge or other vessel in any inland waters.

The captain, master or other person for the time being in charge of the vessel.

Persons present at the appointed time on the premises of any civil prison, lock-up or other place of detention.

The Governor or other person for the time being in charge of the premises.

Persons who, not having been enumerated elsewhere, arrive at any of the places or premises above-mentioned after the appointed time and before the returns in respect of persons present on or in such places or premises at that time are required to be delivered up.

The person specified above as the person by whom the returns are to be made with respect to the persons present at the appointed time on or in any of the places or premises above-mentioned.

Persons in the State at the appointed time and not included among any of the classes of persons above-mentioned.

The person in respect of whom the return is to be made.
