PORTABLE THRESHING MILLS ORDER, 1947.

I, PATRICK SMITH, Minister for Agriculture, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), and of every and any other power me in this behalf enabling, hereby order as follows:—

1. This Order may be cited as the Portable Threshing Mills Order, 1947.

2. In this Order

the expression "the Minister" means the Minister for Agriculture, the expression "the appointed period" means the period beginning on the 1st day of September, 1947, and ending on the 31st day of July, 1948,

the expression "portable threshing mill" means a threshing mill designed or adapted to be conveyed from place to place by a steam engine or an internal combustion engine,

the word "licence" means a licence issued by the Minister under this Order authorising the hiring out of a portable threshing mill during the appointed period.

3. (1) The owner of a portable threshing mill may apply to the Minister for a licence and every such application shall:—

(a) be in writing and contain such particulars as the Minister may require,

(b) be accompanied by the fee directed by the Minister for Finance to be paid in respect of a licence, and

(c) be sent to the Secretary, Department of Agriculture, Dublin.

(2) A licence shall relate to one portable threshing mill only and, accordingly, where a person wishes to obtain two or more licences he shall make a separate application for each of them.

(3) On receipt of an application duly made under this Article for a licence, the Minister may, in his discretion, grant or refuse the application.

(4) Where the Minister refuses an application for a licence he shall return any fee which accompanied the application.

(5) The Minister may attach to a licence such conditions as he thinks fit.

(6) Where any condition is attached to a licence, the licensee shall comply with the condition.

4. No person shall, during the appointed period, hire out a portable threshing mill unless he is the licensee under a licence relating to such mill.
