TOBACCOS (MAXIMUM PRICES) ORDER, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Article 31 of the Emergency Powers Order, 1939 (S. R. & O. No. 224 of 1939), as amended by the Emergency Powers (No. 173) Order, 1942 (S. R. & O. No. 166 of 1942) (which Orders are continued in force by the Supplies and Services (Temporary Provisions) Act, 1946 (No. 22 of 1946)), and of every and any other power me in this behalf enabling, hereby order as follows:—

1.—(1) This Order may be cited as the Tobaccos (Maximum Prices) Order, 1947.

(2) This Order shall come into operation on the 13th day of May, 1947.

2. References in this Order to selling shall be construed as including references to agreeing or offering to sell or to inviting an offer to buy.

3. In this Order the words " Plug," " Flake," " Coil," " Roll," " Twist," " Pigtail," and " Chewing," and the expressions " Cut Plug " and Long Square " shall have the meanings attached to them by custom in the trade.

4. No person shall sell any brand or description of tobacco mentioned in the Schedule hereto at any reference number otherwise than by weight.

5.—(1) No person shall sell any brand or description of tobacco mentioned in Part I or Part II of the Schedule hereto at any reference number at a price exceeding a price calculated at—

(a) if sold under the conditions set out at the head of column (4) of the appropriate Part of the said Schedule, the rate set out in the said column (4) at the said reference number ;

(b) if sold otherwise than as set out at the head of column (4) of the appropriate Part of the said Schedule, the rate set out in column (5) of the said appropriate Part at the said reference number.

(2) No person shall sell any brand or description of tobacco mentioned in Part III or Part IV of the Schedule hereto at any reference number at a price exceeding a price calculated at the rate set out in the appropriate Part of the said Schedule at the said reference number.

6. Where any brand or description of tobacco mentioned in Part II or Part III of the Schedule hereto is sold in the container in which it was packed by the manufacturer for the purposes of sale by retail in such container and the weight of the contents is stamped or printed on the container or any label attached thereto, the container shall, for the purposes of this Order, be deemed to contain the said weight of tobacco.

7. For the purpose of this Order fractions of one halfpenny shall be regarded as one halfpenny.

8. The Emergency Powers (Tobaccos) (Maximum Prices) Order, 1943 (S. R. & O. No. 249 of 1943) is hereby revoked.
