THE TRANSPORT ACT, 1944 (ALTERATION OF MAXIMUM RAILWAY CHARGES) ORDER, 1947.

I, SEÁN F. LEMASS, Minister for Industry and Commerce, in exercise of the powers conferred on me by Section 74 of the Transport Act, 1944 (No. 21 of 1944), hereby order as follows :—

1. This Order may be cited as the Transport Act, 1944 (Alteration of Maximum Railway Charges) Order, 1947.

2. The schedules of maximum railway charges settled under Section 72 of the Transport Act, 1944 (No. 21 of 1944), on the 26th day of June, 1946, are hereby altered in accordance with the Schedule to this Order and such alterations shall come into operation on the date of this Order.

SCHEDULE.

PART I.

SCHEDULES OF MAXIMUM RAILWAY CHARGES APPLICABLE TO CÓRAS IOMPAIR ÉIREANN AS SETTLED BY THE MINISTER FOR INDUSTRY AND COMMERCE ON 26TH JUNE, 1946, UNDER SECTION 72 of THE TRANSPORT ACT, 1944 , TO BE ALTERED AS FOLLOWS :—

(1) Scale of charges in respect of Goods and Minerals by Merchandise train :

Charges to be increased by twenty per cent.

(2) Scale of charges for Small Parcels (other than Returned Empties) by Merchandise train :

Substitution for scale of charges in operation immediately prior to the date upon which this Order shall take effect of scale of charges as set out in Part II of this Schedule.

(3) Scale of charges (inclusive of Terminals) for Returned Empties by Merchandise train :

Charges to be increased by twenty per cent.

In determining the amount to be added to the maximum charge in operation immediately prior to the date upon which this Order shall take effect fractions of one penny if less than one-half shall be dropped and if one-half or more shall be charged as one penny.

(4) Scale of charges for Rolling Stock by Merchandise train :

(i) Railway vehicles running on their own wheels, viz., Carriages, Passenger Luggage or Brake Vans, Horse and Cattle Boxes, Carriage Trucks, and other Vehicles for Passenger Train Traffic :

Charges (including Minimum charge) to be increased by twenty per cent.

(ii) Engines and Tenders running on their own wheels, Railway Motor Carriages with engines combined, running on their own wheels, Railway trucks running on their own wheels, e.o.h.p. :

Charges to be increased by twenty per cent.

In determining the amount to be added to the maximum charge in operation immediately prior to the date upon which this Order shall take effect fractions of one penny if less than one half shall be dropped and if one half or more shall be charged as one penny.

(iii) Charges included in Scale (ii) above for services performed by the Company at the beginning and end of transit :

Charges to be increased by twenty per cent.

(iv) Private Owners' wagons sent to wagon works for repairs, loaded on other trucks :

(a) The service of loading :

Charges to be increased by twenty per cent.

(b) The provision of trucks when the Company's trucks are used :

Charges to be increased by twenty per cent.

(5) Scale of charges in respect of merchandise of an exceptional character by Merchandise train :

Charges (including minimum addition) to be increased by twenty per cent.

(6) Scale of charges in respect of Animals by Merchandise train :

Charges to be increased by twenty per cent.

Additional charge for service of cleansing trucks after conveyance to be altered to 2/5d. per truck.

(7) Scale of charges in respect of Caravans, etc., by Merchandise train :

Charges to be increased by twenty per cent.

(8) Charges in respect of entries in the Classification of Goods by Merchandise train : Section 1 (A)—General :

Regulation 7.—Charge for the supply of sheet or sheets or a covered van in lieu thereof :

Charge to be altered to 1/10d. per sheet or van.

Regulation 13.—Charges for the conveyance of Wild Animals by Merchandise train:

Charges to be increased by twenty per cent.

(9) Minimum charge for the conveyance of Horses, dead (Knackers) :

Minimum charge to be increased by twenty per cent.

(10) Section VI.—Dangerous Goods :

Items carrying a Minimum Money Charge :

Minimum money charge to be altered to 4/10d.

(11) Section II.—Live Stock.

Regulation 7, (Clause 2)—Additional charge for the service of cleansing trucks after conveyance to be altered to 2/5d. per truck.

SCALES OF CHARGES IN RESPECT OF MERCHANDISE BY PASSENGER TRAIN OR OTHER SIMILAR SERVICE.

(12) Division I—Section A—Milk in cans, churns or butts :

Charges to be increased by twenty per cent.

(13) Division I—Section B—Milk in bottles, in cases :

Charges to be increased by twenty per cent.

(14) Division II—Section 1 :

Merchandise in this Section of the classification of Merchandise by Passenger train or other similar service :

Charges to be increased by twenty per cent.

In determining the amount to be added to the maximum charge in operation immediately prior to the date upon which this Order shall take effect fractions of ·01 of one penny if less than ·005 shall be dropped and if ·005 or more shall be charged as ·01 of one penny.

(15) Division II—Section 2 :

Merchandise in this Section of the classification of Merchandise by Passenger train or other similar service :

Charges to be increased by twenty per cent.

(16) Division II—Section 3 :

Merchandise in this Section of the classification of Merchandise by Passenger train or other similar service :

Charges to be increased by twenty per cent.

(17) Division II—Section 4 :

Merchandise in this Section of the classification of Merchandise by Passenger train or other similar service :

Charges to be increased by twenty per cent.

In determining the amount to be added to the maximum charge in operation immediately prior to the date upon which this Order shall take effect fractions of ·01 of one penny if less than ·005 shall be dropped and if .005 or more shall be charged as ·01 of one penny.

(18) Scale of charges for the conveyance of the Excess Weight over and above the authorised free allowance of Ordinary Personal Luggage accompanying passengers :

Charges to be increased by twenty per cent.

(19) Group 1—General Parcels :

Charges to be increased by twenty per cent.

In determining the amount to be added to the maximum charge in operation immediately prior to the date upon which this Order shall take effect for weights up to and including 112 lbs., fractions of one penny if less than one-half shall be dropped and if one-half or more shall be charged as one penny.

(20) Group 3—Newspapers :

Charges to be increased by twenty per cent.

In determining the amount to be added to the maximum charge in operation immediately prior to the date upon which this Order shall take effect :—

(a) for weights up to and including 112 lbs.

Fractions of one penny if less than one-half shall be dropped and if one-half or more shall be charged as one penny.

(b) for each additional lb. above 112 lbs.

Fractions of ·01 of one penny if less than ·005 shall be dropped and if ·005 or more shall be charged as ·01 of one penny.

(21) Group 4—Empties :

Charges to be increased by twenty per cent.

In determining the amount to be added to the maximum charge in operation immediately prior to the date upon which this Order shall take effect :

(a) for weights up to and including 112 lbs.

Fractions of one penny if less than one-half shall be dropped and if one-half or more shall be charged as one penny.

(b) for each additional 14 lbs. or part thereof above 112 lbs.

Fractions of ·01 of one penny if less than ·005 shall be dropped and if ·005 or more shall be charged as ·01 of one penny.

(22) Group 5—Live Stock :

Section (a) Dogs with chain and collar and (if necessary) muzzle :

Charges to be increased by twenty per cent.

(23) Section (c) Dogs, Asses, Foals, Ponies, Calves, Rams, Sheep, Lambs, Goats, Kids, Pigs and other small animals conveyed in horse-boxes.:

Charges to be increased 20 per cent.

(24) Section (d) (I) Horses, Mules and Cattle conveyed in Horse-boxes :

Charges to be increased by twenty per cent.

(25) Section (d) (II) Live Stock conveyed in Vehicles, other than Horse-boxes, specially provided :

Charges to be increased by twenty per cent.

Additional charge for the service of cleansing trucks after conveyance to be altered to 2/5d. per truck.

(26) Section (e) Wild Animals as specified (conveyed only at owner's risk) in owners' vans ; or in cages, crates or boxes on or in vehicles specially provided ; or in horse-boxes ; or in trucks specially strengthened ; or in covered carriage trucks ; or in vehicles other than those specified :

Charges to be increased by twenty per cent.

(27) Group 6—Bicycles, Invalid Chairs, and other articles mentioned in this Group in the classification of Merchandise by Passenger Train or other similar service, when not conveyed in trucks specially provided :

Charges to be increased by twenty per cent.

(28) Group 7—Loaded Van Traffic (as per Classification) in trucks specially provided :

Charges to be increased by twenty per cent.

(29) Group 8—Merchandise in this Group in the classification of Merchandise by Passenger train or other similar service :

Charges to be increased by twenty per cent.

(30) Group 9—Corpses	}	contained in coffins :
Ashes of cremated bodies

Charges to be increased by twenty per cent.

Fractions of one penny in the total charge to be charged as one penny.

(31) Group 10—Railway vehicles running on their own wheels for Passenger train traffic :

Charges (including minimum charge) to be increased by twenty per cent.

(32) Group 11—Merchandise in this Group in the Classification of Merchandise by Passenger train or other similar service :

Charges to be increased by twenty per cent.

Fractions of one penny in the total charge to be charged as one penny.

(33) Group 12—Single post letters :

Rate for conveyance per letter—to be altered to 5d.

(34) Scale of Charges for the conveyance of Passengers :

Charges to be increased by twenty per cent.

(35) Scale of Charges for Ordinary Season Tickets :

Charges to be increased by twenty per cent.

(36) Scale of charges for the conveyance of Workmen between such points and hours as Workmen's Tickets are from time to time issued :

Charges to be increased by twenty per cent.
