LARGE PUBLIC SERVICE VEHICLES (AMENDMENT) REGULATIONS, 1945.

ROAD TRAFFIC ACT, 1933 .

The Minister for Local Government and Public Health, in exercise of the power conferred on him by sub-section (2) of section 121 of the Road Traffic Act, 1933 , as amended by the Emergency Powers (No. 162) Order, 1942, hereby makes the following regulations, that is to say :—

1. In these regulations the expression " the principal regulations " means the Large Public Service Vehicles Regulations, 1935.

2. These regulations shall continue in force until the Emergency Powers Act, 1939 (No. 28 of 1939), ceases to be in force and shall then expire.

3. During the continuance of these regulations the following article shall be substituted for Article 48 which was inserted in the principal regulations by the Large Public Service Vehicles (Amendment) Regulations, 1942, that is to say :—

Additional Passengers.

48.—(1) Subject to the provisions of this article, a greater number of passengers may be carried in an omnibus than would otherwise be lawful under section 121 of the act.

(2) No additional passengers may be carried by virtue of this article in the upper deck of a double-deck omnibus.

(3) No additional passengers may be carried by virtue of this article in the lower deck of a double-deck omnibus when there are seats unoccupied in the upper deck of such omnibus.

(4) The additional passengers carried in any omnibus during a time which is not a time of peak traffic shall not, subject to the provisions of sub-article (5) of this article, exceed 3.

(5) During a time which is not a time of peak traffic a number of additional passengers exceeding three may be carried in an omnibus by virtue of this article if the conductorof such omnibus is satisfied that undue hardship would be caused unless such additional passengers were so carried, but such number shall not in any case exceed the number of additional passengers which may be carried in such omnibus during the times of peak traffic by virtue of this article.

(6) The additional passengers carried in any omnibus during a time of peak traffic by virtue of this article shall not exceed six or one-third of the sitting accommodation of such omnibus or (where such omnibus is a double-deck omnibus) of the lower deck of such omnibus, whichever is the less.

(7) For the purposes of this article the times of peak traffic shall be as follows, that is to say :—

(a) on week-days :—

from 8 a.m. to 10 a.m.

from 12.30 p.m. to 2.30 p.m.

from 5 p.m. to 7 p.m.

from 10.30 p.m. to 11 p.m.

(b) on Sundays :—

from 2 p.m. to 4 p.m.

from 5.30 p.m. to 7.30 p.m.

from 10.30 p.m. to 11 p.m.

4. The Large Public Service Vehicles (Amendment) Regulations, 1942, shall be revoked.

5. These regulations may be cited as the Large Public Service Vehicles (Amendment) Regulations, 1945.

6. These regulations and the Large Public Service Vehicles Regulations, 1935 to 1944 shall be construed as one and may be collectively cited as the Large Public Service Vehicles Regulations, 1935 to 1945.
