STATUTORY RULES AND ORDERS. 1945. No. 338.

HAIRDRESSING TRADE (CONSTITUTION OF APPRENTICESHIP COMMITTEE) REGULATIONS, 1945.

The Minister for Industry and Commerce, in exercise of the powers conferred on him by the Apprenticeship Act, 1931 (No. 56 of 1931), and of every and any other power him in this behalf enabling, hereby makes the following regulations :

1 Short title

1. These Regulations may be cited as the Hairdressing Trade (Constitution of Apprenticeship Committee) Regulations, 1945.

2 Interpretation

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3 Definitions

3. In these regulations—

the expression " the Act " means the Apprenticeship Act, 1931 (No. 56 of 1931) ;

the expression " the designated trade " means the trade declared by the Apprenticeship Act (Hairdressing Trade) Special Order, 1945 ( S. R. & O. No. 249 of 1945 ), to be a designated trade ;

the expression " the apprenticeship district " means the district constituted to be an apprenticeship district by the Apprenticeship District (Hairdressing Trade) Order, 1945 ( S. R. & O. No. 248 of 1945 ) ;

the expression the " apprenticeship committee " means the apprenticeship committee established by the Act in the apprenticeship district for the disignated trade.

4 Membership and terms of office

4.—(1) The apprenticeship committee shall consist of two appointed members and six representative members.

(2) A member of the apprenticeship committee shall hold office for three years or, in the case of a member appointed pursuant to Article 7 of these Regulations to fill a casual vacancy, for the remainder of the term of office of the member whose place he is appointed to fill.

5 Appointment of representative members representing employers

5.—(1) The Minister shall, from time to time as occasion requires, invite any organisation that appears to him to be representative of the employers engaged in the designated trade in the apprenticeship district to submit to him names of persons for appointment as representative members representing those employers and shall, after consideration of the names (if any) so submitted within thirty days after the date of the invitation, appoint such persons to be representative members representing those employers as he considers suitable to represent the interests of those employers.

(2) If on any such occasion it appears to the Minister that there is no organisation representative of employers engaged in the designated trade in the apprenticeship district, the Minister shall appointsuch persons to be representative members representing the employers engaged in the designated trade in the apprenticeship district as he considers suitable to represent the interests of those employers.

6 Appointment of representative members representing employees

6.—(1) The Minister shall, from time to time as occasion requires, invite any organisation that appears to him to be representative of the employees engaged in the designated trade in the apprenticeship district to submit to him names of persons for appointment as representative members representing those employees and shall, after consideration of the names (if any) so submitted within thirty days after the date of the invitation, appoint such persons to be representative members representing those employees as he considers suitable to represent the interests of those employees.

(2) If on any such occasion it appears to the Minister that there is no organisation representative of the employees engaged in the designated trade in the apprenticeship district, the Minister shall appoint such persons to be representative members representing the employees engaged in the designated trade in the apprenticeship district as he considers suitable to represent the interests of those employees.

7 Cesser of membership and filling of casual vacancies

7.—(1) A member of the apprenticeship committee representing employers who has, in the opinion of the Minister, ceased to be an employer and become an employee shall cease to be a member of the committee.

(2) A member of the apprenticeship committee representing employees who has, in the opinion of the Minister, ceased to be an employee and become an employer shall cease to be a member of the committee.

(3) A member of the apprenticeship committee who has, in the opinion of the Minister, failed without reasonable cause to attend one-half of the total number of meetings held in any period of twelve consecutive months shall cease to be a member of the committee.

(4) The Minister shall appoint a person to be a member of the apprenticeship committee in place of a person who ceases to be such member in the same manner in which the original appointment was made.

8 Voting

8.—(1) Subject to the subsequent provisions of this Article, every member of the apprenticeship committee shall have one vote.

(2) If at any meeting of the apprenticeship committee the members present representing employers and the members present representing employees are not equal in number, the group in the majority may arrange that one or more of its number will refrain from voting so as to preserve equality and, if no such arrangement is made, the chairman of the committee, or, in his absence, the member who is chairman of the meeting, may adjourn the voting on any question to another meeting of the committee.

(3) The Chairman of the apprenticeship committee, or, in his absence, the member of the apprenticeship committee who is chairman of the meeting, shall have a second or casting vote on any question on which the voting is otherwise equal.

9 Places and times of meetings and procedure

9.—(1) The apprenticeship committee shall meet at such places and times as it may from time to time determine to be suitable for the discharge of its functions under the Act, and may adjourn any of its meetings.

(2) The apprenticeship committee shall, save as otherwise provided by the Act and these Regulations, adopt such procedure at its meetings and otherwise as it may determine from time to time to be suitable for the discharge of its functions under the Act.

10 Title of committee

10. The apprenticeship committee shall be styled and known as the Apprenticeship Committee for the Hairdressing Trade (Cork).
