LOCAL ELECTIONS (ADAPTATION) ORDER, 1944.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

WHEREAS the Local Government (Application of Enactments) Order, 1898 is an order of the Lord Lieutenant in Council made under the provisions of the Local Government (Ireland) Act, 1898 :

AND WHEREAS in the opinion of the Minister for Local Government and Public Health it is necessary and proper for giving full effect to the Local Government (Ireland) Act, 1919 (hereinafter referred to as " the Act of 1919 ") that the provisions of Article 5 of the Schedule to the said Order shall be adapted in the manner hereinafter appearing in order to bring such provisions into conformity with the Act of 1919 :

NOW, THEREFORE, the Minister for Local Government and Public Health in exercise of the power vested in him under sub-section (2) of section 10 of the Act of 1919 hereby orders as follows, that is to say :—

1. This Order may be cited as the Local Elections (Adaptation) Order, 1944.

2. Paragraph (b) of sub-article (2) of Article 5 of the Schedule to the Local Government (Application of Enactments) Order, 1898 shall be adapted so as to read as follows, that is to say :—

" (b) for preventing an elector at an election of members of any local authority from subscribing a nomination paper or voting in more than one local electoral area."

3. Sub-article (5) of the said Article 5 of the said Schedule to the Local Government (Application of Enactments) Order, 1898 shall be adapted so as to read as follows, that is to say :—

" (5) If a person is elected as a member of any local authority in more than one local electoral area he shall within three days after notice of the election choose by writing signed by him and delivered to the principal officer of such localauthority; or, in his default, the chairman or mayor of such local authority shall within three days after the time of choice has expired declare for which of those local electoral areas he shall serve, and the choice or declaration shall be conclusive."
