STATUTORY RULES AND ORDERS. 1943. No. 430.

DUBLIN COUNTY COUNCIL (UNIVERSITY COLLEGE, DUBLIN ELECTIONS) ORDER, 1943.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

WHEREAS the Council of the Administrative County of Dublin (hereinafter referred to as "the Council") are entitled to elect one of their members to the Governing Body of University College, Dublin (hereinafter referred to as " the College ") :

AND WHEREAS the Secretary of the Council has been notified that the period of office of the existing Governing Body of the College expires on the 31st day of January, 1944 :

AND WHEREAS sub-article (4) of Article VII of the Charter of the College (hereinafter referred to as " the Charter ") provides that one member of the Governing Body of the College shall be elected by the Council :

AND WHEREAS Articles 4 to 9 inclusive of Chapter VI of Statute I of the College prescribe the procedure to be followed by the Council in elections to the Governing Body of the College :

AND WHEREAS the members of the Council have been removed from office by the Minister for Local Government and Public Health under Section 44 of the Local Government Act, 1941 (hereinafter referred to as " the Act ") :

AND WHEREAS because of the said removal of the members of the Council it is impossible to elect a member of the Council' to the Governing Body of the College in accordance with the said procedure :

AND WHEREAS the Governing Body of the College is a subsidiary body within the meaning of sub-section (3) of Section 52 of the Act :

AND WHEREAS in the opinion of the Minister it is necessary in order to enable the Council duly and effectually to perform its functions under the Charter, to make the provisions in this order contained :

NOW, THEREFORE, the Minister for Local Government and Public Health in exercise of the powers conferred on him by sections 52 and 53 of the the Act and of all other powers enabling him in this behalf hereby orders as follows, that is to say :—

1. This Order may be cited as the Dublin County Council (University College, Dublin Elections) Order, 1943.

2. In this Order the expression " the Commissioner " means the person appointed to be the Commissioner for the Council under Section 48 of the Act.

3.—(1) The member of the Governing Body of the College to be elected by the Council in accordance with sub-article (4) of Article VII of the Charter shall be nominated by the Commissioner in writing not less than 14 days before the 31st day of January, 1944.

(2) Immediately after the said nomination notice of the person so nominated shall be given by the Secretary of the Council to the Secretary or other proper officer of the College.

(3) The word " elected " in sub-article (4) of Article VII of the Charter shall (in so far as it relates to an election by the Council) be deemed to include an appointment made under this Order.

4. Articles 4 to 9 inclusive of Chapter VI of Statute I of University College, Dublin, are hereby suspended in so far as they relate to the manner of the election of a member of the Governing Body of the College by the Council.
