S.I. No. 410/1943 - Gárda Síochána (Appointments) (No. 2) Regulations, 1943.


WHEREAS by sub-section (1) of section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), it is enacted that the Minister for Justice may from time to time, subject to the approval of the Government, make regulations in relation to the appointment and enrolment of members of the Gárda Síochána :

NOW, the Minister for Justice, in exercise of the powers conferred on him by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and of every and any other power him in this behalf enabling, hereby, with the approval of the Government, makes the following regulations, that is to say :—

1. (1) These Regulations may be cited as the Gárda Síochána (Appointments) (No. 2) Regulations, 1943.

(2) The Principal Regulations, the 1942 Regulations, and these Regulations may be cited together as the Gárda Síochána (Appointments) Regulations, 1937 to 1943.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

the expression " the Principal Regulations " means the Gárda Síochána (Appointments) Regulations, 1937 ( S. R. & O. No. 59 of 1937 ) ;

the expression " the 1942 Regulations " means the Gárda Síochána (Appointments) Regulations, 1942 ( S. R. & O. No. 107 of 1942 ) ;

the expression " the Commissioner " means the Commissioner of the Gárda Síochána ;

the expression " the Force " means the Gárda Síochána.

4. Regulation 5 of the 1942 Regulations is hereby amended by the deletion of paragraph (b) and substitution in lieu thereof of the following paragraph :—

" (b) was, during the whole of the year ending on the 31st day of December next before his appointment and enrolment as a member of the Force, a member of the Local Defence Force, the Local Security Force, or an Air-Raid Precautions Service."

5. Where the Commissioner is satisfied—

(a) that a person has such special technical qualifications as justify his appointment and enrolment under this Regulation as a member of the Force, and

(b) that such person is of good character, in good health and of sound constitution and is fitted physically and mentally to perform the duties to which he will be assigned in the Force,

the Commissioner may, with the consent of the Minister for Justice, appoint and enrol such person as a member of the Force without regard to the requirements either of Regulation 4 of the Principal Regulations as amended by the 1942 Regulations or of Regulation 5 of the 1942 Regulations as amended by these Regulations.
