DISTRICT COURT (NEW AREAS) (VARIATION No. 93) ORDER, 1943.

WHEREAS by the District Court (New Areas) Order, 1927 ( S. R. & O. No. 103 of 1927 ), the Minister for Justice, in exercise of the powers conferred on him by subsection (3) of section 47 of the Court Officers Act, 1926 (No. 27 of 1926), appointed certain district court areas for the purpose of civil proceedings in the District Court and certain district court areas for the purpose of cases of summary jurisdiction in that court, including (for both those purposes) the Dublin Metropolitan Area, and also appointed the places and times at which the said Court should be held in that Area for those purposes respectively :

AND WHEREAS if is enacted by subsection (1) of section 5 of the Court Officers (Amendment) Act, 1937 (No. 21 of 1937), that it shall be lawful for the senior of the justices of the District Court for the time being assigned to the district court district consisting of the Dublin Metropolitan Area (in that Act referred to as the senior justice) to determine from time to time the class or classes of business of the District Court to be transacted in each of the several place in the Dublin district court area for the time being appointed by the Minister for Justice for the transaction of the business of the District Court and to determine from time to time the days and hours at which the several classes of such business shall be respectively transacted in the several places so determined :

AND WHEREAS it is expedient, in view of the powers conferred on the senior justice by the hereinbefore recited provisions of the Court Officers (Amendment) Act, 1937 , that the provisions of the said District Court (New Areas) Order, 1927, should be amended in the manner hereinafter appearing :

NOW, I, GERALD BOLAND, Minister for Justice, in exercise of the powers conferred on me by subsection (3) of section 47 of the Court Officers Act, 1926 (No. 27 of 1926), and of every and any other power me in this behalf enabling, do hereby order as follows, that is to say :—

1. This Order may be cited as the District Court (New Areas) (Variation No. 93) Order, 1943.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. In this Order—

the expression "the Principal Order" means the District Court (New Areas) Order, 1927 ( S. R. & O. No. 103 of 1927 ),

the expression "the Senior Justice" means the senior of the justices of the District Court for the time being assisted to the Dublin District,

the expressions "Civil Jurisdiction" and "Summary Jurisdiction" have the same meanings as they respectively have in the Principal Order.

4. Part I of the Schedule to the Principal Order is hereby amended by the deletion therefrom of so much thereof as relates to the Dublin Metropolitan Area and the insertion therein (in lieu of the said portion so deleted) of Part I of the Schedule to this Order.

5. Part II of the Schedule to the Principal Order is hereby amended by the deletion therefrom of so much thereof as relates to the Dublin, Metropolitan Area and the insertion therein (in lieu of the portion so deleted) of Part II of the Schedule to this Order.

6. This Order is made subject and without prejudice to the powers conferred on the Senior by subsection (1) of section 5 of the Court Officers (Amendment) Act, 1937 (No. 21 of 1937), to the intent that the Senior Justice shall, by the exercise of those powers, determine from time to time the class or classes of business of the District Court to be transacted in each of the several courthouses specified in the Schedule to this Order and shall similarly determine from time to time the days and hours at which the class or several classes of business so determined shall be transacted in those courthouses respectively.

(b) The courthouse in Morgan Place, Dublin.

(c) The courthouse in No. 5 Dublin Castle (Upper Castle Yard) ;

(d) The courhouse in Dun Laoghaire, County Dublin.
