GENERAL ELECTIONS (EMERGENCY PROVISIONS) (FORM OF WRIT) ORDER, 1943.

DEPARTMENT OF LOCAL GOVERNMENT AND PUBLIC HEALTH.

WHEREAS the form (in this order referred to as "the prescribed form") of the Writ for a general election of members of Dáil Eireann is prescribed by the Electoral Act, 1923 as adapted by the Electoral Act, 1923 , Adaptation Order, 1938, and is set forth as Form 1 in Part III of the Fifth Schedule to the said Act:

AND WHEREAS the Minister for Local Government and Public Health is of opinion that the modifications made by this Order in the prescribed form are necessary in order that the prescribed form may be appropriate to general elections under the General Elections (Emergency Provisions) Act, 1943 (in this Order referred to as "the Act").

NOW, THEREFORE the Minister for Local Government and Public Health in exercise of the power conferred on him by paragraph (b) of section 7 of the Act hereby orders as follows, that is to say:—

1. This Order may be cited as the General Elections (Emergency Provisions) (Form of Writ) Order, 1943.

2. For the purposes of general elections under the Act the prescribed form shall be modified so as to conform with the form set forth in the Schedule to this Order.

SCHEDULE.

FORM OF WRIT FOR A GENERAL ELECTION.

WHEREAS the President of Ireland (or the Commission exercising and performing the powers and functions of the President of Ireland by virtue of Article 14 of the Constitution) has directed by proclamation that a general election for members of Dáil Eireann shall take place.

NOW, I.............................................Clerk of Dáil Eireann, in obedience to the provisions of the Electoral Act, 1923 (as adapted in consequence of the enactment of the Constitution) and in exercise of the powers thereby conferred on me and of every and any other power me in this behalf enabling do hereby direct you, as the Returning Officer for the County (or Borough) Constituency of..........................................to cause an election to be held according to law in that constituency of ....................................members of Dáil Eireann to serve in Dáil Eireann for the said constituency:

AND that when such election has been duly held, you do without delay certify to me in my office at ....................................in Dublin the names of the members so elected.
