STATUTORY RULES AND ORDERS. 1943. No. 38.

RIVER LACKAGH (FISHING BY HOLDERS OF SPECIAL LOCAL LICENCES) REGULATIONS, 1943.

WHEREAS it is enacted by sub-section (1) of Section 8 of the Fisheries (Tidal Waters) Act, 1934 (No. 24 of 1934), that the Minister for Agriculture may by order make regulations in relation to all or any of the following matters, that is to say :—

(a) the times and the places at which holders of special local licences may fish under such licences respectively ;

(b) the keeping of order among holders of special local licences at or on the particular tidal waters to which such licences relate.

NOW, THEREFORE, I, SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by subsection (1) of Section 8 of the Fisheries (Tidal Waters) Act, 1934 (No. 24 of 1934), and of every and any other power me in this behalf enabling, do hereby order and make the following regulations, that is to say :—

1.—(1) These Regulations may be cited as the River Lackagh (Fishing by Holders of Special Local Licences) Regulations, 1943.

(2) These Regulations shall come into operation on the 25th day of February, 1943.

2. In these Regulations—

the expression " licensee " means the holder of a Special Local Licence issued in respect of the tidal waters of the River Lackagh ;

the expression " fishing station " means any place within the tidal waters of the River Lackagh at which a licensee shoots and hauls a draft net and includes the area within 100 yards at either side of such place.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

4. Every licensee using a draft net for the capture of salmon or trout in that portion of the tidal waters of the River Lackagh which is situated inside or to the southward of a straight line drawn in an easterly direction from Grant's Point in the townland of Castledoe to the opposite shore (hereinafter called " fishing waters ") shall observe strictly the following procedure—

(a) Draft nets shall not be used in the fishing waters at a less distance from each other than 100 yards whether such nets are used from the same or from opposite sides of the said fishing waters.

(b) A licensee using a draft net in the fishing waters on completing the hauling thereof at any fishing station shall not again shoot such net at that station until every other licensee who may be waiting to fish at such station shall have shot and hauled his draft net.

(c) A licensee shall not be permitted to occupy for more than one hour any fishing station in the fishing waters at which other licensees are awaiting their turns to fish.
