STATUTORY RULES AND ORDERS. 1942. No. 484.

MERCHANT SHIPPING ACT, 1906, ADAPTATION ORDER, 1942.

WHEREAS it is enacted by section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), as adapted in consequence of the enactment of the Constitution, that the Government may from time to time by order make all such general or specific adaptations of or modifications in any British statute which, in the opinion of the Government, are necessary in order to enable such statute to have full force and effect in the State :

AND WHEREAS it is enacted by sub-section (2) of section 16 of the said Act as so adapted that whenever any power is given by that Act of adapting any British statute, such power shall extend and apply to every regulation made under such statute and having the force of law in the State :

AND WHEREAS the Merchant Shipping Act, 1906, is a British statute within the meaning of the said Adaptation of Enactments Act, 1922 :

AND WHEREAS the adaptations of the said Merchant Shipping Act, 1906, and of regulations made under section 40 thereof made by this Order are, in the opinion of the Government, necessary in order to enable that Act and those regulations respectively to have full force and effect in the State :

NOW, the Government, in exercise of the power conferred on them by section 12 of the Adaptation of Enactments Act, 1922 (No. 2 of 1922), as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, hereby order as follows, that is to say :—

1. This Order may be cited as the Merchant Shipping Act, 1906, Adaptation Order, 1942.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. For the purposes of Part IV of the Merchant Shipping Act, 1906, and also for the purposes of regulations made by the Board of Trade under section 40 of that Act before the 6th day of December, 1922, and now having the force of law in the State, the several expressions " proper authority ", " proper officer ", and " consular officer ", wherever they respectively occur in the said Part IV or in any such regulations, shall each and every of them (notwithstanding anything contained in the said Part IV or the said regulations) be construed as meaning an Irish diplomatic or consular officer as well as such other officer or officers as they respectively mean apart from this Order, and, in the case of the expression " consular officer ", shall be so construed notwithstanding any qualification in relation to nationality attached thereto.

4. The said Part IV and the said regulations shall have effect in accordance with the provisions of the next preceding paragraph of this Order.
