S.I. No. 422/1941 - Control of Imports (Quota No. 12, Fifteenth Period, Amendment and Second Additional Quota) Order, 1941.

STATUTORY RULES AND ORDERS. 1941. No. 422.

CONTROL OF IMPORTS (QUOTA No. 12, FIFTEENTH PERIOD, AMENDMENT AND SECOND ADDITIONAL QUOTA) ORDER, 1941.

WHEREAS it is enacted by subsection (4) of section 6 of the Control of Imports Act, 1934 (No. 12 of 1934), as adapted in consequence of the enactment of the Constitution, that whenever the Government has, by order made under that section, appointed a quota in respect of any quota period, the Government may, if they so think fit, by order made before the expiration of such quota period increase such quota by such amount (in that Act referred to as an additional quota) as they think proper :

AND WHEREAS it is enacted by section 11 of the said Act, as adapted as aforesaid, that the Government may at any time by order amend any quota order or other order previously made under that Act :

AND WHEREAS by the Control of Imports (Quota No. 12, Fifteenth Period) Order, 1941 ( S. R. & O. No. 199 of 1941 ), made under the said section 6, the Government appointed the period beginning on the 1st day of June, 1941, and ending on the 30th day of November, 1941, to be the fifteenth quota period under the Control of Imports (Quota No. 12) Order, 1935 ( S. R. & O. No. 16 of 1935 ), which relates to certain hose, and appointed two hundred and forty thousand pairs of the articles to which the said Control of Imports (Quota No. 12) Order, 1935, applies to be the quota in respect of the said fifteenth quota period :

AND WHEREAS by the Control of Imports (Quota No. 12, Fifteenth Period, Additional Quota) Order, 1941 ( S. R. & O. No. 365 of 1941 ), made under the said subsection (4) of the said section 6, the Government increased the quota appointed by the said Control of Imports (Quota No. 12, Fifteenth Period) Order, 1941, by two hundred thousand pairs of the articles to which the said Control of Imports (Quota No. 12) Order, 1935, applies :

AND WHEREAS it is enacted by subsection (1) of section 9 of the Control of Imports Act, 1934 , as adapted as aforesaid and as amended by subsection (1) of section 10 of the Control ofImports (Amendment) Act, 1937 (No. 8 of 1937), that whenever and so long as a quota order made by the Government under the Control of Imports Act, 1934 , is in force, any person who is for the time being registered in the register of importers maintained in pursuance of the Control of Imports Act, 1934 , for the purposes of such quota order may, not less than fourteen clear days before the commencement of any quota period under such quota order or, in the case of an application in relation to an additional quota, within such time as shall be appointed in that behalf by the order fixing such additional quota, apply in the prescribed manner to the Minister for Industry and Commerce for a licence to import during such quota period a specified quantity of goods to which the said quota order applies :

NOW, the Government, in exercise of the powers conferred on them by the Control of Imports Acts, 1934 and 1937, as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Control of Imports (Quota No. 12, Fifteenth Period, Amendment and Second Additional Quota) Order, 1941.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. Paragraph 3 of the Control of Imports (Quota No. 12, Fifteenth Period) Order, 1941 ( S. R. & O. No. 199 of 1941 ), is hereby amended by the deletion of the figures and words "30th day of November, 1941," now contained therein, and the substitution, for the figures and words so deleted, of the figures and words "28th day of February, 1942," to the intent that the fifteenth quota period under the said Order shall end on the said 28th day of February, 1942.

4. The quota appointed by the said Control of Imports (Quota No. 12, Fifteenth Period) Order, 1941, as increased by the Control of Imports (Quota No. 12, Fifteenth Period, Additional Quota) Order, 1941 ( S. R. & O. No. 365 of 1941 ), is hereby further increased by two hundred thousand pairs of the articles to which the Control of Imports (Quota No. 12) Order, 1935 ( S. R. & O. No. 16 of 1935 ), applies, to the intent that the said two hundred thousand pairs of the said articles shall be a further additional quota in respect of the said fifteenth quota period and the total quota in respect of the said fifteenth quota period shall be six

hundred and forty thousand pairs of the articles to which the said Control of Imports (Quota No. 12) Order, 1935, applies.

5. Every application made in relation to the further additional quota specified in this Order for a licence to import articles to which the said Control of Imports (Quota No. 12) Order, 1935, applies shall be made within seven days after the date of this Order.
