CREAMERY BUTTER (LEVY) (No. 2) ORDER, 1941.

I SÉAMAS O RIAIN, Minister for Agriculture, in exercise of the powers conferred on me by the Dairy Produce (Price Stabilisation) Act, 1935 (No. 21 of 1935) and of every and any other power me in this behalf enabling, do by this order make the following regulations :—

1. This order may be cited as the Creamery Butter (Levy) (No. 2) Order, 1941.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this order.

3. The Creamery Butter (Levy) Order, 1941 (Statutory Rules and Orders, No. 55 of 1941) is revoked as on and from the 1st day of April, 1941.

4. In this order—

the expression " butter (retail) dealer " means a person (other than the registered proprietor of creamery premises) who carries on the business of selling creamery butter by retail or by retail and by wholesale;

the expression " butter (wholesale) dealer " means a person who carries on the business of selling creamery butter by wholesale only.

5. The rate of levy on creamery butter shall be whichever of the following rates is applicable to any particular class of creamery butter in this Regulation specified, that is to say :—

(a) on creamery butter which—

(i) is manufactured before the 1st day of December, 1940, and

(ii) is not put into cold store under and in accordance with an arrangement sanctioned by the Minister for Agriculture, and

(iii) is sold to a butter (retail) dealer,

the rate of ten shillings the hundredweight,

(b) on creamery butter which—

(i) is manufactured before the 1st day of December, 1940, and

(ii) is not put into cold store under and in accordance with an arrangement sanctioned by the Minister for Agriculture, and

(iii) is sold to the registered proprietor of creamery premises or to a butter (wholesale) dealer,

the rate of nine shillings the hundredweight,

(c) on creamery butter which—

(i) is manufactured before the 1st day of December, 1940, and

(ii) was put into cold store under and in accordance with an arrangement sanctioned by the Minister for Agriculture, and

(iii) is sold to a butter (retail) dealer,

the rate of one shilling the hundredweight,

(d) on creamery butter which—

(i) is manufactured on or after the 1st day of December, 1940, and

(ii) is sold to a butter (retail) dealer,

the rate of one shilling the hundredweight.

6. This Order shall come into operation on the 1st day of April, 1941.
