STATUTORY RULES AND ORDERS. 1941. No. 27.

HOME-GROWN MILLABLE WHEAT (MINIMUM PRICES FOR SALE (WHEAT) YEAR, 1941-42) SUBSTITUTIVE ORDER, 1941.

WHEREAS it is enacted by subsection (1) of section 2 of the Agricultural Produce (Cereals) (Amendment) Act, 1936 (No. 56 of 1936), as adapted in consequence of the enactment of the Constitution, that, where an order (in the said section 2 referred to as an original order) under subsection (2) of section 12 of the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935), has been made (whether before or after the passing of the first-mentioned Act) by the Government in respect of a sale (wheat) year, the Government may, whenever and so often as they think fit, by order (in the said section 2 referred to as a substitutive order), which shall come into operation on the first day of the month next following the month in which such substitutive order is made, do, subject to the provisions of subsection (2) of the said section 2, the following things, that is to say :—

(a) divide, by reference to bushel weights, home-grown millable wheat, the bushel weight of which is not less than the bushel weight declared by such substitutive order to be the minimum bushel weight for the purposes of classification, into such and so many classes as they think fit ;

(b) fix in respect of wheat of each such class and in respect of each month, commencing after the date on which such substitutive order is made, in such sale (wheat) year, the price, in terms of a rate per barrel, of wheat of that class for that month :

AND WHEREAS it is enacted by subsection (2) of the said section 2 that whenever and so often as a substitutive order (in the said subsection (2) referred to as the new order) is made in respect of a sale (wheat) year, the following provisions shall have effect, that is to say :

(a) in case no previous substitutive order has been made in respect of such sale (wheat) year, the new order shall include all wheat included in any class constituted by the original order in respect of such sale (wheat) year, and shall fix, in respect of such wheat and in respect of each month to which the new order applies, a price not less than the price fixed in respect of such month by such original order for wheat of the same bushel weight ;

(b) in case any previous substitutive order or orders have been made in respect of such sale (wheat) year, the new order shall include all wheat included in any class constituted by such previous substitutive order or, where two or more such previous substitutive orders have been made, the last of such previous substitutive orders, and shall fix, in respect of such wheat and in respect of each month to which the new order applies, a price not less than the price fixed in respect of such month by such previous substitutive order or the last of such previous substitutive orders (as the case may be) for wheat of the same bushel weight ;

AND WHEREAS the following order, namely, the Home-grown Millable Wheat (Minimum Prices for Sale (Wheat) Year 1941-42) Order, 1939 ( S. R. & O. No. 204 of 1939 ), was made under subsection (2) of Section 12 of the said Agricultural Produce (Cereals) Act, 1935 , by the Government in respect of the sale (wheat) year commencing on the 1st day of September, 1941 :

AND WHEREAS no previous substitutive order has been made in respect of the said sale (wheat) year :

NOW, THEREFORE, the Government, in exercise of the powers conferred on them by subsection (1) of section 2 of the Agricultural Produce (Cereals) (Amendment) Act, 1936 (No. 56 of 1936), as adapted in consequence of the enactment of the Constitution, and of every and any other power them in this behalf enabling, do hereby order as follows :—

1. This Order may be cited as the Home-grown Millable Wheat (Minimum Prices for Sale (Wheat) Year, 1941-42) Substitutive Order, 1941.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The following provisions shall have effect in relation to the sale (wheat) year commencing on the 1st day of September, 1941, that is to say :—

(a) a bushel weight of fifty-three pounds is hereby declared to be the minimum bushel weight for the purposes of classification, and the expression "home-grown millable wheat to which this Order applies" means in this Order home-grown millable wheat the bushel weight of which is not less than fifty-three pounds ;

(b) for the purposes of this Order, home-grown millable wheat to which this Order applies is hereby divided into the three classes specified in the second column of the Schedule hereto ;

(c) the minimum price per barrel for home-grown millable wheat to which this Order applies of each class specified in the second column of the Schedule hereto for each month in such sale (wheat) year shall be the price set out opposite the mention of wheat of that class in the sub-column relative to such month of the third column of the said Schedule.
